We've got a local road which has been restricted to 40 from 60 as well. Its out in the sticks and not a Black Spot. Its difficult to remember that it is restricted to 40 now so I know how you feel. Seems to be the latest bit of power demo' by the Council.

The road is long and straight and was 60mph - now its 40mph ...... the ONLY thing there is moving about are cows, REALLY!!!
Hmmmmmmmm, interesting hearing people pleading that their illegal speeding is somehow justified!!

PS Lewis has posted over 5000 times on Scoobynet. The amount of time he spends on here I am surprised he finds time to get caught speeding He is one sad man who really needs to get out more

Let's not give anyone a hard time over this, divide and conquer and all that. We ALL have to stand up against the current police and government attitude to revenue generation through making us pay. Let's just consider Pete a new recruit to the fight.

The first thing I suggest you do is accept that there probably isn't any way out of this IF they did clock you and you were over whatever threshold they were working on.

The next thing you must do is take a look here:

Now, this isn't "a mate told me in the pub" stuff but is a genuine appeal to the ECHR. Basically the NIP says "We think you might have done a bad thing, so just sign here and we'll screw you over. If you don't sign then we'll screw you over in a really big way." This is not legal but the case has still to be proven.

So, even though this doesn't give you an "out" it does give you some options:

You can sign the NIP, send it back and forget about it.

You can sign the NIP but clearly write on it that it was signed under duress and is in contravention of your right to silence, common law and Article 6 of the Convention of Human Rights. This opens the door for you to claim compensation once the ECHR decides in our favour but it has absolutely no down sides for you as you don't need to go to court, get legal advice etc. Make sure to document your mental anguish, fines, lost earnings and all expenditure in preparation for your claim.

You can plead not guilty, go to court, and ask for a postponement until the ECHR case is decided as the S172 is in contravention of Article 6. If you currently have points or have good reason not to want any just at the minute then this might delay the case by 3 years. Of course it might not as the magistrate might refuse your request. The down side of this is that you will probably need legal representation etc. and so that will be extra cost. I don't know if you can claim this back if the ECHR decides in our favour but I would guess that you probably could, though guessing isn't worth very much when it comes to the law :-)

So, I don't think there is an easy way out but I do think you have some options which might at least lessen the blow. You might also want to join the Association of British Drivers to assist the fight against revenue generation. We have to fight all we can as there has been no democracy in this country since Thatcher gave the police a pay rise to kick the life out of the miners.

Interesting post Hedgehog.

As a matter of interest, what are you threatened with if you don't sign the NIP? I thought from what someone else said a while ago that there is no requirement in law to sign it as long as you say who was driving the car. Have they thought up a new approach to this?

I believe that the non-signing loophole has been "patched" or at least there is now a consistent policy on the matter which prevents us getting any advantage from it. I think in the past there were, perhaps, a few people who got away with it but that this was based upon inconsistent interpretation of the law rather than there being an actual loophole. They make far too much money from this to allow there to be loopholes. When was the last time you didn't have to pay your income tax because of a loophole?

All that info my be total rubbish but it is what I understand the current situation to be.

I think the ECHR is our best bet. Think about it: they are forcing you to sign that you committed a crime because the penalty for not signing is greater than that of the actual crime. How long before they send out such letters to randomly selected people to improve their robbery clear up statistics? "Admit to robbery and we will fine you £100, don't admit and we will send you to jail." This isn't just a motoring issue but a fundamental matter of civil liberties.

You're absolutely right, of course. The reason for having a go at Pete is simply his anti-speeding comments in a previous thread - it just goes to show how people can join in the Government-sponsored chant of 'slow down' right up until they themselves fall foul of the system. Then, the excuses start. It's called hypocrisy, and that's what Pete is getting a well-deserved hard time for.

Personally I'd love to see him join the ABD and stand with the rest of us who believe that sometimes speed limits are unjustified by the circumstances.

Pete: why not get Matron to help you click here and join some other like-minded people who'll stand up for you in the face of what almost certainly is an injustice.

Well the chances are that if you drive you will at some time get done for speeding, as it only takes a moment of inaction.

I personally would go down the non-signing route. There are a number of people who are doing this on Pistonheads.Com, have a look at the speeding board, and the thread is easily found. Mind you it is about 17 pages long!

No one there has yet been done for not signing, some have heard nothing for months, some have been told they will be charged with not identifying the driver, some have received further copies of the NIP to sign. However none have gone to court yet.

It appears that forcing one to sign the NIP is in contravention of Europan Human Rights legislation hence why the Government hasn't changed the legislation.

I suppose the simple fact is that for a fine of £60 its not worth chasing those that don't sign, when there are many who will.

Its funny how it happens.

4 years of being a hooligan in a Scooby and an Integra R and I get done in a RAV 4

But hey, I was guilty even though I still think its a daft 50 limit on a three lane motorway...

Anyway - take it like a man and stop complaining..LOL..

As an aside, I thought for the type of hand held detection device (laser gun) you describe, they had to stop you there and then?

Didn't think any of the hand held laser guns had cameras inside?

My guess is you will not have registered a sufficiently high speed for them to bother and hence they let you go.

The irony is that you probably got away with it because you were in the MX5..

Looking around at sites on the net and stuff like that I have concluded that there IS a gun with Camera inside in operation!!

However, it should be mounted on a tripod, it wasn't!!

Should be police camera warning signs, there wasn't!!

They should have been visible to traffic, they were hiding in the bushes!!

What chance have I got - their word against mine!!
