That's not funny!!!

Legally the farmer should have some kind of "Public liability Insurance" which you should be able to claim from... the farmer shouldn't be able to claim from you, but it's your word against the farmer's.
As there were no signs, and there was a load of Sh*t on the road the farmer WILL be liable for prosecution (unless it is an unclassified or private road) for not clearing it up... even more so if someone ends up in a hedge!

What a thread: Action, anguish, fun, force, cow cursers and calf consolers

Hopefully this will find a happy end.

If the farmer is that violent he certainly has a record. And in that case it is to be assumed he is not very gently towards his dairy maschines.

Maybe legal advice is the best advice here. Get the best you can, it pays off.

Why not wait until the road is really sh*t up and deliberately skid your car off the road and into the ditch/wall. Call an ambulance and the old bill,claim nasty whiplash injuries and sue the **** off the turnip cruncher!

Where damage to property or injury to persons or animals is involved, and if for any reason you have not been able to give any of the details required to be given when you stop, you must report the accident personally to a Police Officer or Police Station as soon as possible. At the latest, this means within 24 hours.

Failing to stop and failing to report are both serious offences.

The Police will usually require you to produce your driving documents and failure to do so within the time stipulated (usually seven days) is also an offence.

Section 170 does not actually require that drivers have to produce their licence or insurance details to the other driver (/farmer ).

Reporting to the Police means a personal attendance at the Police Station and a telephone call will not do.

OMG, the missus just phoned, she took a drive up there this afternoon to have a word with the farmer about his insurance details, apparently theres a 10 foot hole in one dry stone wall and the farmers BMW has the side caved in from one of the enraged pat producers !!

The farmer was very obnoxious to my missus and suggested that we're gonna have to pay for the wall to be rebuilt and the repairs to his Beemer !!

I'm going to the cop shop on my way home to report it personally so we'll see what tomorrow has to bring

I'm glad that this has amused people a bit, personally I'm far from aMOOsed !

I hope all his cows step on mole hills and break their legs !

if he can prove you were responsible then you will be liable for the damages he has sustained

sorry norm - it's not looking too good. as long as he were breaking no rules on livestock movements - might have a slim chance with us still in the BSE aftermath then i think he is in his rights to move his cattle along the road. if this is the case he will have a good case that you started the stampede.

your car insurance will not cover this damage!!!

OK guys, I'm glad you've all had your fun outta this

Well I've been to the cop shop and apparently I AM liable for the damage to the wall. Yes I admitted hitting the horn and flashing the lights and explained that the reason for this was the aggresive attitude of the farmer.

The police guy said that the farmer had denied acting as though he was gonna rip my head off but as I had admitted irresponsible behaviour with regard to causing a stampede that any damages resulting from it were my responsibility !! Can you believe it ? FFS !!!


There is NFW that I'm going to pay this f***ing RETARD for the damage to his wall, and as for his car, I feel like BBQ'ing the fu**er !!!

Now you aint gona believe this part, after I visited the plod hole I went home past the offending farm again and yes theres a BFO section of dry stone wall missing, yes theres a BMW with a black and white $h1tbags forhead imprinted in the wing so I stopped and called in.

He's gone and pleaded all innocent because the police have verified his right to move cattle on the highway as long as he cleans up the sh1te !! (Which he never does).

He's offered me a couple of alternatives which he called the LPB (low pay back) and HPB (High pay back). He reckons that if I pay him for the wall he'll rebild it himself at a lower cost than a proffesional, BUT...............


I also have to buy the dead frikkin cow off him !!! Looks like it's BBQ's for the rest of the summer !!!

As far as he's concerned all the Flashing and hooting caused the Damage to his car so he's gonna claim from my insurance for that. I thought 'I'll Silence him' and suggested that we go knock for knock on car damage but the b@$tard Planted me one !!!!!! I kid you not, I've had stars Pinging in front of my eyes for the last two hours !!! I've got to say that I'm not an agressive type myself so I didnt fight back, my brain said GoGoGo and I legged it. The shame is that there was nobody but him and me there so I've got no witnesses !!!

He told me that if I didnt pay him for the cow and the wall then I'd be in for more than a simple Assault !

I really dont know what to do now as I feel I've no alternative but to pay up or face prosecution.

Help (again) !!!!

Get your wife to take photos of your face, and get back to the police station, report it and then go to hospital and get them to look at it. Have him for assault. Or at least tell the police you want to, and have them put a restriction order on him to not come within so many metres of your house as he has assaulted you, verbally assaulted your wife and i would be scared for my family.

Then you have evidence of a facial injury. Make sure you state exactly how he hit you and exactly which hand it was, etc.

Surely the fact that he has hit you make this about as believeable as Mary Poppins.

Update definitely required!!!

However I would suggest that being close enough to the cows to let one get on your bonnet was possibly an error of judgement.

If I see anything on the road bigger than a person it gets 4 or 5 bus lengths!

I don't know: I wasn't there: you may have been 100% in the right. It certainly sounds like the farmer could do with an attitude adjustment.

hummmmm....i would have thought common sence dictated that a cow would not have been able to stand on all fours on your bonnet !!
would it not have been better to let the cow do whatever damage it was going to cause & then sue the farmer for damages....after all its only about £27.00 to take someone to the small claims court !!...............instead YOu have now made a mountain out of a mole hill !!......................bloddy funny though.....looks as though is now a case of 6 of one & half dozen of the other !!!....I.E both you and the farmer are to blame....jeez....keep posting tho mate.....i aint laffed this much since my mum slammed her tit in the car door !!
