Interesting. Thanks for posting.

I'll take them to court local to their offices in Uxbridge. Now I live some 300 miles away. If I win I will be claiming for a hotel, meals and travel expenses; say £500.

Great response

Re the parking eye - A guy whom bought a car from me whom works at a retail outlet kept packing his new car (my old one) in a area that was forbidden. I receive the parking fines, all 4 of them. I contacted the buy of the car, he said to ignore them, so I did...... more letters came, I contacted them, they said I was liable........... I didn't pay and the issue went away and they eventually sent me a letter stating they are happy the issue has been resolved ?!?!?!?

Taking a photo of your car with the badge displayed does not prove that it was displayed correctly at the relevant time.

Be careful, it's not up to you to prove your innocence, but for them to prove your guilt.

Small update.

After I sent them the last letter and having not heard back since, I guess it's off to court we go. I'll be form filling later today or tomorrow and will post once it's on its way to them.

I find it hard to put into words the totally over zealous way we treat parking offenders in this country.
Watching 'Parking Mad' on BBC1 last night.If you didn't know you would think they where hunting down serial killers or child murderers.Police out in force.ANPR van.Baliffs.Recovery & tow vehicles.

An utterly disproportionate response.What is the 'crime'? What is the damage?What is the cost? What is the damage to society.

People stopped & told their car will be impounded & sold within 5 days.
Parking that cost them a few pounds now built up into many hundreds or thousands.

What other crime where you owe someone a few pounds for something that causes no-one else any damage except take up a parking space for a few minutes or hours could result in such a massive over reaction bringing the full weight of the criminal justice system down on you & non-negotiable response?

I am not saying people should not get fined or we should not seek to recover the fine.I am just saying the fines should be much,much lower in response to the 'crime' & have a fixed maximum amount.It should never be criminalised & remain a civil matter as a lot of debts are.
We need to take a step back & realise what we are doing & stop this totally disproportionate response to what is just a very minor issue.

It just a f**king parking space that costs a few quid to use after all.

I couldn't put it better myself.

These parking companies should think about their fines/cost they impose and how disproportionate they are say when you compare it to some ****** who causes £x thousands of damage (criminal) and yet gets a small fine. Probably never pays it anyway and on the other hand you get someone who hasn't paid a £30 parking fine which balloons into a £1000 debt with the threat of their car being towed away. THAT is just plain wrong !!

I remember a time in the early to mid 80's when you could simply bin a ticket and had a better than evens chance of never hearing anything from it again

Then, in the late 80's early 90's things changed - like so much of life in the UK

Changed in the sense that they would come after you, it was all computerised, no escape - like the parking enforcement version of the terminator - relentless

I remember (1996) having a £16 ticket go to £180, which was a lot of money back then

I had no choice to pay, my own fault - head in the sand and all that

That day (the day my now wife paid it on her credit card lol) I vowed never to do that again

Subsequently, if I got a ticket I either appealed (coz I though it was issued in error), or paid it there and then, on the phone - Bosch

So actually I don't have to much of a problem with this - I suspect the people who let it get to £300, in the main, are the same people who don't insure / tax their car, don't pay income tax etc etc

Totally agree. I too agree that people should be accountable if they do things wrong in one way or another, but the 'crime' really doesn't match the punishment at all.

I am busy trying to get a metro fine overturned for a friend from work in a similar situation. She mistakenly pressed the wrong button for her journey (long story but she was rushing to get to work from a different station to the one she usually used) so still had a ticket, it was just not the correct fare. When her ticket was checked she immediately offered to pay the 80p difference, but they refused and want a fine of £20 paid. I wrote one letter for her explaining the situation, but they are refusing her appeal. It's just not proportionate.

So, I am also having an rgument with parking eye at the moment.

We work in supermarkets, and alot of them to get to the loading bay, you have to go through the car park thus triggering their cameras.

Now the loading bay is not attached to the car park and not under "parking eyes" control.

So I send them a letter to this effect, after the 3rd letter of them refusing to answer my queries I did as the OP has done and said I can provide documentation etc to the effect and further correspondence will be charged for and set out my rates etc.

They have just replied saying that they have declined my appeal and i owe the £120.... There are no reasons for the decline of the appeal, just that they have. What bunch of ***** can decline an appeal without giving full details of their reasons why they have declined an appeal etc ?

Whats my next step?

It seems to be a case of common sense versus the jobsworth. The scale of response and the subsequent inflexibility when things go obviously awry is simply wrong. I question the IQ of the attendants who seem to take very obvious pride in having 'got' someone, no matter the circumstance. They need better training and scale of the punishments needs thinking about, as you say Lisa. Perfectly decent people are demonised for one off offences when you can go round any town centre and see drunken crime, often violent, all over the place. Focus on real crime? Nah, doesn't pay enough.

Who would you have go after real crime? These same private companies? Isn't worth thinking about. The problem, yet again, comes down to money. Private companies have that one goal, public companies work for the better of the community, without financial incentive and as such are on a back foot from the start. Going after the real crime that you mentioned requires paying more taxes.

Police.

The point is that as a society we (at a bureaucratic level anyway) seem happy to demonise the motorist whilst turning a moral blind eye elsewhere in society. A shift in emphasis in terms of levels of toleration does not necessarily require tax. How the tax is spent and the policy making is the first port of call before you throw more money into the system.

Heard a solid rumour that the hospital I work for have contracted out the hospital parking to "Parking Eye"...............now that's going to be fun as patients often stay a lot longer than expected, not to mention the staff.

Ignore them and let them take you to court. No way a court would rule in their favour if you can prove and have tried to explain three times. I would send a recorded delivery letter though, just to stop them claiming no letters have arrived.

Okay folks.

The claim is going in now.

This is what I've said in my statement.

"I parked in a car park in Aylesbury town
centre which is under the control of UK
Parking Control Ltd. I had a disabled friend
with me and we parked in a disabled bay in
accordance with the instructions displayed.
Both the blue disabled badge and the 'free
for 2 hours' parking ticket which was
dispensed by the machine were played on the
car's dashboard. We returned to the car after
approximately 15 minutes to find a parking
charge notice left on the bonnet of the car.
I could see no parking attendant around so I
wrote to UK Parking Control Ltd to show a
photograph of the car displaying both the
blue disabled badge and the parking ticket. I
advised them in the letter that I considered
the matter closed and that any further
correspondence from myself would cost them a
£50 administration charge per written
communication. They wrote back saying that
the charge had been correctly applied and
that they would not pay my admin charge. I
have written to them again and explained that
I would pursue my admin fee through court."

They've 14 days to respond......

It's cost me the princely sum of £25 to do this. If more people stood up to these shysters the world would be a happier place.

So far I've taken 2 cases to a small claims court and have won both times. Lets hope it's third time lucky too!

Couldn't they simply say you moved the badge before taking said picture?

AFAIK it hasnt been mentioned, but if they dont have a picture of the front of the vehicle then they dont have a leg to stand on, because

1) why would you display a badge in the rear of a vehicle?
2) it is up to them to prove your guilt, not for you to prove your innocence, which they cannot do as they dont have a picture of the front of the vehicle

This will be their point. It was on display and you can clearly see that it's a valid disabled badge. However it had slipped a little behind the tint at the bottom of the windscreen. They have said two things in separate letters: 1 - that it wasn't displayed clearly and 2 - that it wasn't displayed (at all).

I've sent them, in my first (and only free) letter to them a photograph of it on display. You can CLEARLY see that it's a valid disabled badge, which should be sufficient. However, they just want to ***-rape people so I'm going to fight this all the way. Yes, I could of ignored it, but I'd rather it cost them money in going to court.

Additionally, they sent me a photograph of the rear of my car! I have since looked on their website and they have a photo of the car with the badge displayed. The photo look the same/similar to mine, so they're just being pedantic and trying to make money with their pathetic excuse of it not being displayed correctly (or at all ).

In their previous letter they asked if you were the holder of the blue badge - how does the law stand given the badge can't be linked to you or your car reg? I watched the parking mad programme and there were a couple of folk fined for using someone else's blue badge, I wonder if you'll need your friend to contact them as well to say he was in the car with you.

Parking eye or similar do not have any "law enforcement" rights, so cant touch you for it!

The OP wasn't using someone else's blue badge. The owner of the blue badge, who was with the OP at the time of parking, was using it. Blue badges relate to a person and not any particular vehicle.

The cases you've seen on TV are when able bodied persons use a blue badge belonging to a family member or friend just to use a disabled vehicle bay to park themselves.
