Default Rights when buying 2nd hand parts?

Wondering if anyone knows the rights when buying 2nd hand parts from a breaker, ie: how many days they should allow for warrenty

If they say 30days and a part breaks just after those 30days where would I stand with regards to getting a refund?

I think you've answered your own question.

You're not going to get a refund if its out of warranty. 30 days is a months use, on a 2nd hand part, if you want a guarantee buy new.

2nd hand parts are always a risk, theyre used so theres no way of knowing what lifespan they have left.

What did you buy?

To be honest, it's just bad luck. You were lucky to get a warranty in the first place as most breakers won't warrant second hand parts.

Yea it is bad luck, I am gutted it's a lot of money to loose, and I have hardly used the car since it's been fitted, was doing 30mph and went to change gear and it made an awful sound, was not driving it hard either

If it is from a dealer then you have the same legal rights as if it was new.

Apart from the fact that it obviously can't be perfect or have the same service life..... It all depends on how long a second hand box should be expected to last if it was free from defects at the point of sale.

Also was the box the correct one for the car (i.e was it the correct for the rear diff), get it wrong and it'll work, but not for long - something will break (box or diff, whichever is the most worn)

This is interesting. I think you did well to get another box out of them, fair play!

When we sell second hand parts we give a 7 day warranty. That way you get long enough to check that they work, but we make it very clear before you buy that if it fails after that, that's the chance you take buying a second hand part.

If its been refurbished/reconditioned then I can see why the seller would be responsible, but then the price would increase accordingly too.

Im not saying its wrong but I find it hard to believe that a seller can be responsible for something that he would know nothing about its history. And who makes the judgement call on 'when a second hand part would likely to fail'? It depends on 'how second hand' it is! A gearbox could well be 19 years old if it was taken from one of the first Impreza's!

Sale of goods act 1979 applies to new and used /sale items.... snipped on the watchdog site under "fit for purpose"..
