Default help with insurance claim PLEASE

Ok lads please dont laugh. I need help, this morning i got up to my phone ringing (as im on call) i had an emergency i had to attend. So 4:30am i rushed to the clinic. However, on my way out i managed to drive onto my neighbours drive and crash into his car knocking it off it axle stands onto the discs and the sump.

i dont know how i did it, morning daze i guess. Anyway, as it was early and i had to leave i left a note saying that i'll call round when im back etc.

so now that im home he comes round and we talk, im very apologetic and said i will sort it through my insurance. This is when he said that he wants to use his mechanic and me to pay cash.

I told him he can use any mechanic he likes but as for me paying cash its just not happening. i think its because his car isn't insured as he is rebuilding it???

im going to tell my insurance company anyway to cover myself, but if his car isn't insured will i be liable for the damage???

i agree...i bet the guy is probably not insured. surely he can still claim against your insurance regardless? if that's the case he will have to have his car taken to where your insurers recommend i would have thought. if he is insistent of wanting cash...then i guess he can go to small claims court. unfortunate situation mate.

Is there any damage to your car? Depending on the age and value of your neighbours car the insurance may write it off so what he is probably wanting to do is avoid this as the money he may have put into the car would not be recouped. If you could get a mechanic other than his to have a look at the car to see what it would cost to repair then compare this to the possible increase in your premium.

hi mate if hes got the car off the road anyway just pay for the parts that got broke and let him fit them.thats what i would do and be greatfull the guy wants to sort it

its a escort cossie it mint too. it normally in the garage but he was having his engine taken out today.

it done body damage too from where i hit it and from when it hit the ground. his mechanic is here now and i have got my mate who is a mechanic to come round and they are working out whats needed.

Why go through your insurance. your a 100% at fault. why have a claim against you. What kind of car is he rebuilding anyway. ask him to tell you what damage there is, and get your own mechanic to look at the damage and come to a comprimise...

its a escort cossie mate and it is in mint condition. now havin the price worked out. but i can safely say its going to be more than what my pockets can stretch to.

He should be insured because the car is parked at a place to which the public have access....what would happen if the postie was delivering his letters down his drive and it fell off the axle stands and broke his leg.

Sounds like an insurance job to me .

our houses have foot paths seperate to the drive so the postman would have no reason to be there.

sounds unfortunate for both you and the neighbour but a escort cosy houses the front diff in the sump so that will be proper expensive on its own never mind the all the other parts, why was he having the engine out it anyway? watch you don't get stung for more and more if you go the cash route, for unnoticed damage to the engine and other parts.

Whether his car is insured or not is neither here nor there. Pretend it isn't a car you hit and it was his garage door instead. Your car insurance should pay out for damage to his property that you caused.

However, as it is a car that you hit I suspect that he doesn't want your insurance company involved as they will likely write off his car as its worth to him is more than your insurance company will pay.

Hope you woke up enough when you got to the clinic to deal with patients!!

no he has all the parts for his rebuild and ive seen those. he's building cos he was big power it wasnt broken. untill this morning lol

he might want to go down the cash route if he hasnt declared his mods,if his car is not insured your insurance will pay for the replacement of what he has got,if he is insured and not declared his mods,then he will only get standard replacements.i would ask him all the questions first and go from there.good luck mate,i hope you dont get stung.

Yes, of course. Youre liable for the damage caused due to your negligence, insured or not, and your insurer has to indemnify you. You might find that its cheaper and easier to pay though; so let it develop for a short and friendly while, to see what he proposes. If youve already told them though; youre stuffed with regards to future declarations, so you have nothing to lose (apart from NCD and your neighbours neighbourlyness)...

P.S. IMHO, once you are past double your excess, hand it over to the insurance company. You did the damage, now they will make you pay for it. Till you swap insurers at the next renewal...

no joke Dr Joseph drove into a parked car. its sorted now. insurance will pay for the damage and my neighbour is fine about it. im just glad i wasnt in my scooby.
