Stupid letter from DVLA!!

Stupid letter from DVLA!!
I'd like to say I can't believe this but......
I recieved a letter from the DVLA today,
my vehicle (correct reg etc) was seen driving up and down my street (correct street) on the 17/12/2009 whilst being declared SORN
sounds normal but.....
It has no engine, as that is currently at API being built!!!!!
The letter even says that they will accept £138 as a fine payment instead of going to court

On the statement form I have just written that the car is mine but it certainly was not driving up and down my street. The only time it will be is when it goes up to API on a trailer to get the engine fitted.

I wasn't being a smart **** ... actually .... I did think you had a fantastic defence!! 
Can you prove, beyond all doubt, that the car inquestion could not possibly be used due to the lack of an engine on 17/12/2009?
If so, tell them that you will defend yourself in court and will be looking to them for damages!
However, be aware that they 'may' have you on film/digital camera, so - be very sure that you were not using the car on that date before you commit perdury.

Was meant as a joke.....nevermind 
unless someone was doing Flintstone impressions in it while I was at work, I'm more than sure I wasn't driving it

If you know the car didn't move on that day - then go to court, they simply cannot have any evidence to prosecute ..... and they need to declare the evidence, ask for it!
Heresay is not evidence.
No need to do anything except respond to their evidence - which they cannot have.
A quick tip ..... be extremely brief in your reply (do not ramble on or post threads from a Forum) one sentence asking for their evidence ..... I have seen lots of people hang themselves because they gave the opposition too much rope!

Same Plate, Same Street? Unlikely I would have said .... clones tend to operate many 100's of miles away from the cloned vehicle in my experience. To get a clone of your SORN'd car up your street would be quite staggeringly unlucky!

Just seems odd really, the car is even on a private driveway.

I agree, alot of work would have to go into cloning the actual car as it is quite unique. I'm leaning more towards the idea of someone sick of seeing it on the driveway (private drive that belongs to our block of flats). Probably think its a waste of a parking space.

Be a little careful. For any reason was your car pushed onto the road to wash it etc?
Despite it not having an engine they'll still have you for it. I know round by me i often see there vans driving around with 4 cameras on the corner of the roof.
It is possible as they've drove past your house the camera has picked up your reg and a letter has been sent automatically.

just a thought but is the letter defo dvla (where does it ask for payment to go) as this could make for a petty cash scam!!!! id check with the dvla that its genuine first. If it is genuine then looks simply to me go to court with proof of engine being at api at time of alleged offence also proof/witness that said engine is from said car and that the car was/is imobilised at time

I don't want to be a damp squib, BUT: if these things go to court, and IF the DVLA evidence is someone working for them, (via the local council), who reported this offence at the time, then who do you think magistrates will believe?
And you'll end up paying a BIGGER fine, plus costs PLUS a victim suport £15.
Just my take, and I'll believe I'm wrong when I see the evidence.

Well I've spoken to the housing association who actually own the driveway and they have confirmed that it is private and infact the whole street is private, all owned and maintained by them! They are writing me a letter stating the above and that I have permission to park my vehicle on their driveway.
The car isn't with David yet, just the engine, I took everything to him.
I'm not worried if I end up going to court. I know that its impossible to drive my car in it's current state, I can prove I was at work from 6am to 7pm (although they didn't specify a time) on the 17th December, plus now it turns out that my whole street is owned by First Wessex Housing and not the council. I always thought my ground rent was bloody high!
