Road Rage - do I have a choice?
The solution to this, is absolutely NEVER EVER EVER run with your doors open in a 30 zone. Always keep them locked if you think you are going to stop for whatever reason.
I once saw a situation similar to this that put me into doors locked mode.
Chap driving a 214 rover about 1:30 am in main street of stirling up here. Drunk chap doesn't watch where he is going and the rover emergency stops from 20 mph to ensure and not hurt the drunk. The drunk bashes off the side wing. The drunk walks round to the passenger door calmly, opens the door leans right across and takes the driver who is seat belted up and smashes his head on his side window several times. The police are no more than 10 metres away and did nothing.
NEVER run with my doors open. Even when some people get in my car who think they are pretty solid i still run the doors locked at low speeds as they will not get hit a sly one before they get to choose to get out and solve the situation.
Also he has no witnesses for the dangerous driving, so tell him that was CRAP, you have no witness so u are pretty much scoobed aswell. Dont think the whole thing will go anywhere more than a warning. If you have his reg you could think of regularily reporting him for driving badly. You could hand it out here and we could do the same. He would get much police hassle and this perhaps would compensate.
Considering how mad some people are u are lucky to have not been badly injured. The only time i dont lock the doors is when my fiances fathers in the car. Hes a karate instructor of many many years, otherwise the door is locked.
glad your ok considering some of these loons

that sounds absolutely awful, and I dont think there is any way they can get you on a dangerous driving unless you genuninely were....which it doesnt sound like you were from description.
no accident was caused, therefore despite you being slightly in the wrong, you arent actually guilty of anything. line markings on roundabouts are there to ease traffic flow, they are NOT law (except for chevrons which are...)
Ther is no excuse for this guys actions.
Ther are only 9 accredited Thai Boxing instructors in the UK - and 7 are from Thailand and Korea. I know the 8th well and this would never ever be him (in fact no decent martial artist would ever act like this) So he was talking bollocks frankly.
Your address should be completely safe if you do proceed
dunno about trasffic cams - may or may not be running - but they will get written over in fairly short order - so do it quick if you're going to.
Dunno if it's worth it or not - only you know how scary that was....seems a real shame that anything like that can happen though....
cheers

When you say traffic cameras, I presume you mean the CCTV sort. If this is the case, they are ALWAYS live and recorded. The tapes are kept for 31 days in accordance with Home Office guidlines.
I can't see that the CPS would bother running with a dangerous drive, but you never can be sure.
Did you get the name of the company who owned the lorry? If you did, speak to their transport manager and explain that unless the matter is resolved to your satisfaction you will report the driver for assault etc.
Your address will be confidential. Information like that is covered by the Data Protection Act 1988. They cannot release your details.
If you have a solicitor or know someone who is, speak to them and see what they reckon.
If you need any more advice e-mail me on the_black_rats@hotmail.com.

OK. Typing this while still shaking...
Driving up through Reading today, trundling along dual carriageway behind huge old lorry carrying some old portakabin type thing. Get to roundabout - Three lanes with two straight on and one to turn right. Lorry now in middle lane with me behind and some traffic in left lane. Lights go green... lorry doesn't move. After a couple of cars from behind me have jumped the lorry in the right hand lane to go straight on I indicate, pull out, follow and pull back in front of the lorry which has now just started moving .No problem lots of room. Wrong lane I know over a couple of chevrons. Byebye lorry - carry on driving.
Mile up the road queuing for M4 junction. Car door opens, my keys are whipped out of the ignition and some raving loon is screaming at me to get out of the car (looks like he’s from McDonald’s, London, Monday if you get my drift). After much deliberation (I don't have my keys and therefore closing and locking door not an option) I get out to be ranted at.
Rant rant rant - You know what you did? You cut me up back there - rant - made me emergency brake - rant spittle on face- rant- made my load shift four inches <<Hmm sounds safe>>> rant rant.
Profuse aplogies from me - explained I thought his lorry had stalled, etc. "You're only $%^%£& sorry coz I've got your keys" (True or I’d be f%&ing dust mate…) Calm calm calm Joolz. Just act scared won’t do it again, etc.
It was 'explained' to me that the only reason I didn't get a mighty fine kicking (he's a thai boxer instructor apparently…hmmm) is because of the police traffic monitoring camera on the roundabout – I was lucky he didn’t get me at the previous lights and next time he sees me I'll get a pasting.
Ends up with me getting verbal abuse, punch to the gut (fortunately there's some padding there and certainly didn’t feel like a punch from an instructor who was trying!) and my keys thrown into my face (lots of keys - ouch)
Did the honourable thing and called the police on arrival at work. Explained situation to friendly copper who basically said that they would most likely advise lorry driver to throw a dangerous driving case at me in defence of my assault and threatening behaviour cases that would be against him. I would have to visit station to make a formal statement for this to proceed further.
Now with no witnesses for either instance (must have been 100 cars drive past me getting bawled at who didn’t give a s*&t (unsurprising), what can I do?
I have a scooby WRX planned in next couple of months (and thanks for all the advice on this BTW). I'm sure Admiral insurance will love to see a dangerous driving endorsement on my license- Ka-ching they say. Meanwhile I drive round in a bright green sports coupe saying ‘Kill me you lunatic’
What is the situation with regards to this dangerous driving thing? Innocent until proven guilty?
Was he carrying an unsafe load for it to shift?
Is my residential address confidential if I proceed?
Are these traffic cams all live and taped?
Do I just buy my new car and ‘hide’ in my sexy new scoob?
Be safe out there dudes… This was too scary for words.

Lucky escape me thinks ...
Sounds like you were lucky this bloke did'nt deck you if he was soooo angry .... my alarm locks all the doors within 8 seconds of the engine starting ( ignition on actually ), I know this causes concerns but I feel a lot safer when wifey is out and about in it with the kids as we have had BM's and scoobies car jacked around here as I imagine other parts of the UK have. Having said that he would of probably damaged you door in frustration at not been able to get at you .... who knows .. Having driven a truck about for a local company I can see both sides to an argument, the average ( note average, and it's no slight at you mate
) driver has no thought for a HGV at Junctions and islands and no matter how much education and indication they seem to have it's always the HGV at fault when cars try to squeeze up the inside at junctions and then the HGV turns left and the inevitable happens. The recent adverts and slogans on the back of HGV's is sooo right "If You Can't See My Mirrors, I can't See You" and you would be amazed at the amount of "blind" spots the average truck has. But then again some HGV drivers are raving mad to say the least ... IMHO obvoiusly

K
re traffic cams, Guidelines are just that, and not always followed.
We had a recent incident on the M8 where a baby got killed because of a road rage accident. It was on camera, but NOT video'd apparently.

Given that you were punched, I would press charges. Mind you, I do have a *very* low opinion of lorry drivers in the first place.
I would have thought the main problem is that you don't have any witnesses, and you may therefore have problems in securing a conviction. On the other hand, he has even less chance of getting a dangerous driving charge to stick.
If there is a police video of the original incident, then you're laughing, as it'll confirm your version of events. If not, then it's your word against his. I would have thought it very unlikely that you could be convicted of dangerous driving in the absence of any independent witnesses or video evidence -- surely dangerous driving involves much more than (allegedly) cutting someone up on a roundabout on the say so of the other driver. I'd be more worried that the lorry driver might be able to get you on a lesser charge, such as driving without due care and attention, especially if you crossed chevrons or a solid white line. But I still feel that's very unlikely, given the lack of evidence.
Personally, I feel the behaviour of the lorry driver is completely unacceptable, and I would take matters further. I can't help feeling, though, that the likeliest outcome is that the police will give this guy a warning, but that's better than nothing.

Lucky escape Joolz.
I agree with the above comments that you were acting quite within the law (chevrons...what chevrons
). As you said, you thought the HGV vehicle wasn't going to budge so you followed your MSM procedure and curtailed the obstruction. Either way it doesn't give this thug the right to open your car door and take your car keys, let alone assaulting you.
Thai K. Boxing instructor... Let me say that having been in the M. arts arena for some time now, no self respecting instructor would threaten someone with the backing that they instruct the sport let alone hit someone unless they thought they had to defend themselves. Most instructors keep a low profile when it comes to physical confrontation and they tend to be the most chilled out guys you know. (Well there are exceptions to every rule I guess)
At the end of the day you are going to have to follow/action what you believe is right, regardless of outcome.
Just think though, if you had a WRX the traffic would have opened up in front of you like Moses and the red sea...
At least you got an afternoon off work for it, bargain.

Have you ever seen this lorry before?
I doubt you'll see it again. I also doubt any good would come out of pursuing this. Whilst it might not be satisfactory your best bet is to write it off to experience and be thankful he was just a gob$hite.
You can bet your life the hypocrite pulls out at junctions uninvited and cuts people up on roundabouts. Let he who is without sin cast the first stone and all that. Touchy git.
Incidentally, if you thought he'd broken down, did you offer to help?

I just had a second thought about this. Have some peace of mind. People who get out of their trucks/cars all the time and threaten people will eventually bump into a very very very bad person. The result will not be in their favour and justice will be served.

Joolz - sorry to hear about the incident. Sounds really bad
.
I can't believe that the police said that they would advise the truck driver to bring a dangerous driving charge: it's not their position to do that. It's up to his solicitor. Also, the fact is that the driver assaulted you. Even if your driving was dangerous (which it doesn't sound like it was), that doesn't justify assault and is no defence to it. If I were you I'd try and get the video from the traffic camera showing the assault. Do it now before they wipe it, then decide if you want to push them to prosecutre him. I would also contact the company that owns the truck and make a formal complaint to them. Who knows - the driver may make a habit of this kind of behaviour and your complaint (especially if backed up by video evidence) may be the last straw.
I <I>always</I> drive with the doors locked, to avoid possible thefts and road rage lunatics.

You must feel really shook-up about this. People like that lorry driver are unhinged & there are a lot of them about. They operate outside the law. My suggestion is that the police will not help. The driver will get your address & then your life will be hell. Take the sensible option & drop it. Going for it can only cause you grief & give a raving lunatic a real reason to hate your guts. DON'T phone his company!

My problem exactly Nick,
Thanks everyone for all your comments, much appreciated indeed and nice to be reassured that the world is not full of complete w$%kers like the guy this morning...
Guess I should count myself lucky he was just a vanilla lunatic and not a knife lunatic. To answer a few points...
All I have on this guy is the number plate. No witnesses. I checked the Police traffic cams (CCTVs) on the way home today and there are exactly two cameras sat on top of a single mast covering an entire junction of the M4/A33 (from the other side of the roundabout). Chances are that as the route I take through the junction was pretty much free of traffic then the cameras were probably pointing away (in fact pointing down the motorway which is always ballsed up). Seeing the distance between the incident and the cameras (roughly 75m) I guess he was giving himself an excuse to not give me a slap. Hence he’s not so hard after all. Also means no evidence=no case.
Respect Lorries? Absolutely - they can smash up my car without noticing and I always keep out of their way on roundabouts etc. I've driven a few big trucks (no HGV's, mind) and know the difficulties involved from the driver's POV. This guy was, IMO, broken down. As for offering help, I wouldn’t know which end of the truck to start looking
Locked doors? Well the horse has bolted now but certainly something I did on the way home and will continue to do. I can afford a couple of dented panels I guess if someone wants to take a kick at the motor. In fact the hire car I was using just a few weeks back in Canada locked the doors about 10 seconds after starting the engine. What did I do? Unlock them of course (Accident paranoia - do any of these mechanisms unlock doors in the event of a crash?)
Never seen the lorry before. Wouldn’t remember it if I did to be honest. It was a big old heap with a K Plate. I made a point after getting back in the car of noticeably writing down the registration plate while he drove up to withing an inch behind my bumper and held down his horn (giving me a full on rear window view of the plate, the dumbass!!!) I would have preferred to follow the company route but can't as the lorry behind had no company markings. Then again what would the foreman be like to hire this type of person?
Thai Boxing Instructor – Well I expected that to be bollocks but I didn’t want to push things when not in control of the situation. Perhaps he means he goes out on the town kicking seven shades out of strangers and then tells his mates? I thought most martial arts were based around respect and control. Hmmmmm.
Guess the whole intimidation thing shows why so many people are scared of reporting crimes. I really believe that there will be not a lot of good in following up on this as the Surveillance cams are unlikely to help. Perhaps if I was a Thai boxing instructor… Now there’s an idea.
TFYus – I hope you’re correct about the bad person thing. There is no way this cowardly ****head would open the door on a car with more than one person inside. He may well open the door on one nasty person one day however and that thought makes me feel better. It’s the surprise factor that throws you. I had absolutely no idea what to do. Moral: Lock your doors!
The Police didn’t say they’d advise the driver to take the dangerous driving charge. He was just telling me the possibilities from experience. Did seem a little like scaring me off to save on work however and more the sort of 'advice' I'd expect from a solicitor.
Greg – Portacabin/House comment - You could be right there
‘A warning is better than nothing’ – Don’t agree with this one at all. In my opinion this sort of loose cannon would treat a warning as a direct assault and rile them up even more to come after you, if they are indeed that way inclined. I do not want my family in potential danger (read “‘should’ not get your address” in thread) for the sake of some tosser getting a warning.
Guess it's yet another excuse to buy the Scoob. That’s 4,365 and counting…
Joolz… Unhurt, shaken and definitely stirred.
PS. Anyone know where to get those anti-hijack flamethrowers for the side of your car

I'm always wary of people around the car. And flame throwers are no good if the guy had time to open your door and take the keys.
Keeping the doors locked is the only way....especially if you have a 4 door.
If the above happened to me i'm afraid i'd loose my rag and go for him!! It's because i'm a redhead I suppose
I keep my scooby keys in the house like the Crown Jewels !!!
Gethin.

regarding the fear of crashing with the doors locked
I open my door with the key sit in it IMMEDIATLY close the door, immediatly lock the door and THEN start the car. I had a think about it one time and if i was a car thief i would wait till they had started the car walk up open the door RIP them out of it and then drive off. That way i wouldn't even have to fool about with imobilisers. SO after that thot, i now lock the doors before even starting the car, my fiance does the same. Then putter about town with the doors locked and when the speeds go up unlock the doors so if you crash and are stcuk in the car then a passer by can still open the doors.
Take it from me, I know quite a few people that if that guy had done what he did, regardless of there only being one man in the car, he would have, how can i put it, decided apon looking back that it was a BAD idea to do so.
If this is a typical thing this idiot does, expect him to be found dead in a layby one day.
I tell you something tho, i BET that never happens to you again, a major learning experience! Chin up and dont let the fvckers get you down.

Chin up and dont let the fvckers get you down.

hi all,
had one of these incidents a year or so ago,
story was guy with mrs+ 2 kids in escort cut me up on roundabout (he was in a lane that was solid lined to go round)forces me to take avoiding action just miss a car on its own dedicated joining lane, i JUST flash this idiot, 300 yards up the road which is now a dual carrige way he decides his outside lane is moving slower on approaching a set of traffic lights , so he cuts in front of me again, i duly flash again , on stopping at the lights he jumps out a runs up to my door , starts wrenching at the handle (locked)his face red as a beetroot, with this my brother (6'4" lorry driver)say's unlock the door which i duly do , this block starts ranting that i should have known he wanted to be in my lane at the roundabout!!, by this time my bro is out of the car and belting round the back of the car, the bloke looks round and sees him coming, i've never seen someone go so white so quickly, he was back in his car 5 sec's later, his wife starts shouting out the window about calling police , i thought great how would they explain it, as it was they just drove of . I'd like to have been a fly on the wall that night in their house. I just could'nt beleive someone would act like that especially with kids in the car.
it does take allsorts.

Joolz, sorry to hear about the incident, have to agree that you were lucky (if you can call it that) to get away with a soft punch and some keys in your face. Could have been much, much worse.
Don't get into retribution. If you'd assaulted the guy back you would now be looking at a jail sentence (ask a certain farmer). Even being a Thai boxing instructor yourself won't help much if the lorry-driving loony pulls a knife or a gun.
Gut feeling? You won't get anything out of this by pursuing him through the courts unless you can get some witnesses. Otherwise it's just your word against his. Try & get some evidence or witnesses to back up your case, maybe get some legal advice if you plan to pursue things (which deep down I think you should!!).
I always lock my doors, even before I saw someone jump into another person's car and start assaulting them. I guess the risk of being trapped is less than being assaulted (and what makes you think that unlocked doors can be opened after a car has been in a 70mph crash anyway? They get pretty mangled).
Above all, thank your lucky stars & I hope you never suffer something like this again.

I had a similar incident about five years back. I'd cut someone up near Chelsea Bridge (unintentionally, but nevertheless I was in the wrong) and then had the car door wrenched open and the keys taken out when I came to a halt in traffic.
The bloke was very abusive and after making several attempts to punch me, eventually threw my car keys across the road and put a nice dent in the car door with his foot.
Stupid bloke - he was a black cab driver. I stress the 'was' - the City of London Police take a very dim view of this sort of behaviour and took his licence off him.
My advice is - DEFINITELY make a formal complaint to the police, contact his company, do whatever you can. Idiots like this should not be on the roads, and you can bet that some other poor sod will have had the same treatment in the past.
It'll be very unlikely that you'll face any sort of charge, but even if you don't get him prosecuted for assault, you might just get him worried enough that he'll think twice next time.

Sorry to hear you bumped into yet another moron.
One of my former work collegues had a similar incident but luckily had got the company name from the van and the reg. I called the company and spoke to a senior manager re the incident. My colleague then followed this up with a written complaint and hey presto one sacked employee and a nice appology and damage covered.
Work collegue had done nothing wrong and van driver decided to kick in the side of his carfor some pathetic reason.
I've had a few scrapes in my time and have learned. Lock doors if in doubt and have a phone handy. This might make someone think twice before going into moron mode for fear of the police turning up.

Kinda similar thing happended to me in Tooting 6 yrs ago. Guy ended up head butting me and taking out my front teeth. Luckly managed to get a Traffic Warden to act as a witness (I now love all traffic wardens). Took the guy to court, he got a 2 yr suspended sentance. His Son - a police office tried to "tamper" with the case and got the book thrown at him. The guy had to pay me £20 per month for 2 year as compensation. Evey month when the check came in my fair in the justice system was renewed.
After being attached like this I went through the should I shouldn't I debate. My wife said No - what happens if he come after me again. In the end I decided that the guy had effected my life enough with the trauma and I would not let him get away with it - even if I was exposed to a very small risk of further greif. In hindsight I am very glad I sought, and recieved justice for having my life invaded by a van man.
Oooer - That was getting a bit deep.

Soon they will be handing out a special kit, 3 alsation dogs, and one caveman with a sh!tty big club with nails in it. They are in the boot at all times and with the touch of a red button the boot opens and the problem is quickly solved. The alsations drag the body into the boot on their way back in and feed on the remains.
I thought that running the chap over with his own truck ( with his house on it ) would be just.
but luckily i dont make the laws

I'm soory to hear of your story & your injury. I completely agree with your decision to press charges in this instance.
However "recieved justice"??? I think not. Suspended sentence to van man means nothing. Maybe a higher standing among his mates in the pub? Then he paid you a total of £480 for smashing out your front teeth? Would Cindy Crawford (insert other name as required) get £480? I think not. That sum is an insult. I bet the dental work alone cost that.
grrrrr.

Sorry to hear about your incident ! But thought I might be able to humour you with the following.
A number of years ago my brother (a 6"5' 50 Inch chest bouncer) owned a moggy minor. Unfortunately, his seat had collapsed, so from outside the car, he didn't look very intimidating !! On morning the car was playing up so I agreed to follow him to the garage to drop his car off for repair. On the way, a post office van cut him up, so my brother horned him. At the next set of traffic lights the moron got out of the van shouting a number of expletives at my brother and generally implying he was going to kick his *** !! I still p*ss myself remembering the look on the guys face when he yanked the door open on the moggy, and my brother swung himself round in his seat and got out !! Needless to say the guy dashed back, jumped in his van and took off through the red light. That was funny enough, but going through the red light also triggerred the Gatso !!!
The moto being what goes around comes around!

!!!ROFL!!!
Nice one Greg,
When you wade around the country with an attitude too big to fit someone's going to not agree with you and you're going to end up hurt.
Fortunately I got away with this pretty much damage-free. For someone to get their teeth knocked out like Jon mentions above is just completely out of order, and obviously the work of a madman. We've all tooted the horn or flashed the lights at someone who's cut us up in the past but to get out of the car and basically threaten someone with a beating has got the be the workings of someone who needs help but simply can't afford the lobotomy.
It would be interesting to see victim vehicle stats for assaults of this nature (Hate to call it road rage). Morris minor's like you've stated are going to be somewhat near the bottom of the list, or am I overestimating these goons' brains? Is this a case of 'Bright Shiny Object Syndrome' perhaps. (Or maybe I simply need to sue for mental problems from the shock
)

PS. Not wanting to pigeon-hole someone for their car (I read the cossie board for that
), but who was this post van driver expecting to lamp - some 70 year old granny and her yorkshire terrier? Very Brave. If that was a 5-litre Yankee 4x4 now...

Joolz,
Having thought about this a bit more.....this is all personal opinion...
I would prosecute if I was you - or at least find out if there's enough evidence to let you...simply because the next time psycho boy loses his rag someone could get very hurt indeed. You were lucky, the next person might not be. As Alex says, at least this might make him think twice. If you do, and any trouble comes of it (highly highly unlikely) post a note and someone will be in contact about sorting it all out.
cheers

And does anyone know whether I am able to check whether there is any camera evidence BEFORE jumping in all guns blazing.
Agreed someone could be hurt (including the idiot involved which obviously is not a problem). As I've stated in one of my last posts, the guy was a loser anyway and was probably looking for an excuse to scare some 'suit' because he wouldn't be allowed in the suit shop in the first place. If he'd wanted to deck me then he could have - Nobody driving by gave a **** and the cameras were miles away.
On a purely selfish front, remember I have nothing to gain in this. Much to lose however.
Scores on the doors:
Guilt at leaving this **** on the road vs. Daily paranoia + insurance grief
Chances are, if I'd had my doors locked and not been surprised, the guy would have twatted the car. He'd then have be introduced to Mr Maglite, legal or not.

What is the world coming to?
When I had the mondeo I got into the habbit of locking the doors when I got in, and now it's almost second nature, though I have been forgetting to do it in the WRX, but I will certainly start doing it again. Especially as I usually have susie, ali, and jam, in the car with me and I'd rather have the car smashed than them or I being smashed up.
I would love to say that I'd get out and give the SOB a piece of my ind but I'm too much of a fraidy cat, even though I'm sort of intimidating, being 6ft 4in and 15 stone. All it takes is for the nutter do a 'Noye' and you're done for. And I'd rather not have my loved ones seeing me being done in, I'd rather have to fork out for a new bit of metal.
Keep safe out there.

my moto is simple, lock the doors, dont get out for ****, if the fvcker doesn't get out of the way run them down, and i mean fvcking flaten them then get their reg plate keep it safe and decide on the next course of action from a safe point. I bet you were wishing u had some back up in the car. It never happens when its like that
basic story that happened to me
i was driving my wee blue 1.3 a reg mark 3 escort out the bypass near falkirk. I had deb in the passneger seat. i over take a chap and then pull back in, we come up behind traffic and he strts tail gaiting me. Im in the wee blue 70 hp thingy and hes in a 320 old sytle beemer.
I over take another car and he follows i slow down for a roundabout and he has beent aili gaiting me consistantly. i pull over to the inside of the roundabout and slow down as if to say well if you wanna go fast on you go then! I dont know if i caught him out but rather than over take he must have had a fright and locked up, i carry on round the roundabout for another lap, doing about 25 mph, he comes up behind me again, just as that i see five car loads of my friends away up the motorway for a race, they are about 20 metres away but i cannot get there atention as they are flying thru the roundabout to go up the motorway, i then carry on cruising and he FVCKING rams me! BAM, i dive the left and emergency brake to put him infront of me, he tries to cut infront of me to stop me, let me note this guys about 28 massive shaved head and absolutely RAGING! when he dives out of his car i totally go for it ( in the 1.3 ) manage to catch up my friends eventually when they are cruising the other way back down the motorway...police get involved but nothing happens.
How annoying, atleast 10 lads were no more than 20 metres away and if we had cb's the problem would have been SORTED rapid. But alas i was in the 1.3 so it was hard/impossible to get away and i had my fiance in the car not davey or whitey ( total psychos )
anyhows, we survived and if we ever met him again it would be interesting esp if the boys were there.
