ebay theft
 
I’m not going to post any of the sellers details just want advice

Bought a phone as "100% brand new" phone arrived, very second hand, filthy scratched, call and text logs listed on it. anyway contacted the seller and he advised to send it back and he would refund my money, sent the phone back by recorded delivery and nothing !
no contact with the seller for over a week so i opened a dispute via paypal, he then contacts me to advise he would pay me as soon as i rescinded the action.
Against my better judgement i did and now nothing!! he doesn’t respond to my emails and now i have rescinded the action PayPal will not open another dispute on the same item ! ive reported him to Ebay, no response. He continues to actively trade on Ebay. Again reported him as a fraudulent trader and i await Ebays response.

Any ideas ?

How long has it been since reversing the dispute?

In fairness the money is frozen by paypal usually so he cannot refund the money until the dispute is closed. But its also a clever scam.

Just out of interest what was the feedback rating of the seller like ?

reversed it on 29th Dec, hes had the phone back since 14th Dec !!!! hasnt responded since i lifted the action !!

his 275 activity rating was ok, about 98.8%

Are you able to reopen a dispute? I have never tried that.
Have Ebay or Paypal had anything to say about it ?

Has the phone been relisted?
Just wondering if its a hijacked account or something

Sorry pal, you've been suckered and lost your money.

Now the case is closed, Paypal will do even less than the feck all they'd have done had you kept the dispute open. You can't re-open it. The amount will be too small for the Police or small claims to be interested in, so best just chalk this one up to experience or pop a suitably worded letter in the post by recorded delivery and see what happens.

think a visit to his home, or place of work may be an option if he doesnt cough up. face to face negotiation is always the best option i find

Keep an eye on his future listings and put a bid in for £1000000 on every one and it may be help to start a few bogus accounts up in your wifes /kids/friends name to help it along...works a treat

Indeed it is, i once was conned on flybay and the bloke only lived 5 miles away, i knew him ( with my account ) and i was bidding with my brothers account! his face and tremble when i was banging at the door:lol1:. and i did get my monay back :D

everytime the seller has an item for sale, bid and win the item and then refuse to pay im sure the seller will love a taste of there own medicine

If the guy has feedback of 275 mostly positive then I can't see him ripping you off purposefully for a mobile phone. Does he have any active listings/activity?

Maybe he's gone on holiday

I don't do or understand e bay but offering for sale a 100% brand new phone and sending a knackered used one sounds a bit wrong

You have his address so should be able to find out his number, ring him (and record it) so you can see what the story is.

You can go though the small claims court, it will cost £25 to start a claim I think (which you claim back from him if you are successful), he has to reply with his side of the story or the Judge will rule in your favour and you can send in the baliffs.... https://www.moneyclaim.gov.uk

Did you have a photos of the phone as you recieved it? any other proof/documnets/emails all these can be used in your favor.

Go round an recover the debt yourself. If you dont feel confident in donig that take a friend with you

Trust me he will give you the money if you turn up

If you dont fancy that start posting him dog **** an anything else you want

Start terrorising him until he refunds you

Then make posters with his name an address on them stating he is a paedophile.

A bit extremem but people need to learn its bad to rip people off
