Speeding ticket.
 
Me and a mate were driving our cars on a local bypass and overtook an unmarked cop car. We did a u turn at the next roundabout and were soon followed by said copper.

He pulled us over and said he was doing us for excessive speed on a single carriageway.

When sat in his car we asked how fast we had been clocked at he said that he didnt have us clocked as such but had us on camera, we asked to see the video, to which he said we cant and got on his high horse and said he was gonna do us for speeding, dangerous driving and racing. :eek2:

He eventually changed his mind again and said we could have a fixed penalty notice.

Now this all seems a bit strange to us as he says he has a video but wont show us, says we were speeding but hasnt got us clocked.

Do you think we should call his bluff and see him in court or take the 3 points and thank our lucky stars?

see him in court, in ur defence u have the option to see the proof u were speed either but video or by the speed gun,he has neither so go to court,u will win hands down

He says he has a video but wouldnt show us it. But if he does have a vid and we go to court we could become pedestrians for a month or so.

If you didn't admit to anything and he didn't have any evidence it has been your stupidity in accepting 3 points unless you admitted driving over the speed limit at which point your fecked . Easy to tell if the car had a video camera in it, as it would of been fixed on the dash ;)

If he has been given 3 points at the scene it has to mean that an offence has been commited and noted, going to court is to call his bluff and see if he can get out of the 3 points ;) Otherwise why would he even bother thinking of going to court:smug:

Didnt admit to nothing, he gave us the choice go to court or take 3 points (took 3 points for now can always change my mind and go to court) yes he did have a camera but theres nothing to say that it was rolling at the time.

if you dont have your license on you then you get 7 days to decide, if you've got it on you, you get about 30 seconds.

my advise (for what its worth!) when they ask if you have your license on you always say no

Is this for defenit as he said he cant show us it, it will be put in a sealed bag at the end of his shift and not opened until court day.

If what you say is true it makes us think he hasnt got us on tape.

If it was rolling the cameras pick your speed up as your acclerating away from quite a far distance with superb clairty. So if you were speeding bad and he does have you( they nromally show you the vid) your gonna be well and truelly shafted if you go to court, but if he doesn't have any eveidence and you didn't admit anything you will get off with that with a solicitors help ;) Are you a gambling man :D

I got an sp30 thru the door and I just ignored it as I din't know wether or not to go to court ??? I think I got 6 letter from the police threatening me with instant action if I did not plead guilty to the offence. I think I finally paid it after 4 months and still no court action :D

I havent admitted to anything. Yes I took the ticket but that doesnt mean that you admit to it you still have 7 days to appeal.

Only read the initial post, so sorry if I repeat anyting said.

You didn't say if you were racing, speeding or driving badly/dangeroiusly, so hard to say if you should fight it.

You have no legal right to see the footage of the alleged offence at the scene of the issue of the ticket, and it's up to you if you belive what he said. I assume the officer was alone? If he was, then it's 99.9999999999% sure it is on camera.

From experience I'd never call a bluff where traffic and tickets are concerned as they are issued with the knowledge that you flick a switch when following someone that records everything.

I never issued anything without being safe in court.

No offence, and I'm not trying to be thick here, but were you speeding?

If not, by your own admission, you said you were faced with the choice of go to court, or take the points, and that you were unable to see the footage, why accept the points at all?

If you were not in the wrong here, it doesn't matter if there is a video or not at that time, to a point, as if there is, you are in the clear, if not, they have to prove you were speeding without any evidence to back up their claim. I know that some police are less than honest etc. and that people get shafted, but on your part, I can't understand why you would pretty much admit guilt by accepting this punishment, if you knew you hadn't committed an offence.

If you were caught out, regardless of being shown any footage, then I guess unfortunately it may just be one of those things you have to just put down to experience.

I am unsure of the speed that I was doing doing while I overtook the feds but I believe he was doing well under the speed limit.

I doubt the speed that the officer was travelling at is relevant. But if he had to break the speed limit to to catch you then, through pure logic, you must have been speeding.

You can only request prosecution evidence once you're fighting it.

I realise that: I was presuming that this could only be invoked if the video did indeed contain evidence: do you see what Im getting at? I was under the impression that simple video of you driving along and being stopped would be covered by the act.

The continuity would be made from the officer's notes being linked to the video and caution, and subsequent FPN being issued.

The there's the issue of equipment being cailibrated, etc - a loophole that has been closed by better houskeeping.

There are still a few driving loopholes left, but not many.
