Ebay
Have bought an Xbox off ebay which I paid for via PayPal, this item I know is not going to be posted as the seller has confirmed he was conned by his supplier. He has offered a full refund but 4 weeks later nothing, on the item I won it has PayPal Buyer protection up to £500, is this something I will automatically get or that I have to sign up for. Did try phoning PayPal but seem to disappear into a money making 'On hold' call to them.
I have already started the PayPal dispute process and escalated this to a claim, but wondered what the protection is. I've already spoken with my CC company but since PayPal are not the supplier the can decline the claim from them Any help much appreciated Cheers Nick |

been nearly 2 years, still waiting for my protection to cough up :rolleyes: all they did was ban the other member because he never replied and i never got a penny :cry: Good Luck |

Give them 30 days to sort it out before you commence legal proceedings. They will either pay up within 30 days, or failing that they'll not contest your claim and you will win by default. |

The £500 "protection" is a wonderful idea- so long as there is £500 in the Paypal account of the scammer to give you the money back....

AFAIK ebay own paypal and simply don't give a toss about their public. And still they keep coming back!

The £500 buyer protection applies even if the seller has nothing in thei account. There balance will simply go negative and they will owe PAYPAL. I have founf PAYPAL always work in favor of the buyer so you should be OK. You will get an automatic refund if seller does not respond or cant provide a parcel tracking number.
Go onto the 'Dispute Console' page of the PAYPAL account and all relevant information should be there. |

Will have to wait until 3rd as that is the date for the seller to respond, if not PayPAl will award to me, but no guarantee of return of nearly £360 |
Update as it's the 3rd, just received this from PP
"We have concluded our investigation into your case and have decided in your favour. We were able to recover 358.32 GBP, and this amount has been credited to you. Please allow five business days for this adjustment to be posted. If you are due any additional funds, we will make our best effort to recover the balance from the seller. If the seller's account has insufficient funds to complete the refund owed to you, please be assured that we will take appropriate action against the seller's account, which may include limitation of the seller's account privileges." Does this mean I will actually have the money credited to my CC account as the product had the £500 protection. Seems Para 2 says one thing and Para 4 says another. |

You will get the money from Paypal - I had a similar incident a few months back and they didn't argue - just make sure you follow their process, because it's very difficult to get to talk to them and if the process is messed up it's even worse.
Incidentally, if you paid the Paypal invoice with a credit card then the CC company is absolutely liable as well under section 75 of the Consumer Credit Act 1974. Consumer Credit Act 1974 When you talk to the CC company mention the act. |

Thanks for the replies, notice the cheeky s0ds will hold onto the money for up to 5 days, so I guess it will be Friday before it appears against the CC.
I did try and phone PP last week and all that happened is I disappeared into their money making holding system |
