Car being sold with outstanding finance!!!!!
It has come to my attention that someone is planning to sell their car (non scooby and NOT me!) and pocket the cash without paying off the finance company :eek:
I know its non of my business but I dont like to see people being ripped off :mad: so what would happen to the poor sod who buys the car? Is the new car owner liable for the outstanding finance if they knew nothing about it? The moron selling is moving to Scotland so thinks he will get away with it, but I overheard him bragging to his mate in the pub last night and I'm tempted to put a spanner in the works :p What would you do? About a year ago i brought a pug 306 for £6000 went to the chaps house to view it asked if any outstandind finance told NO so struck a deal .
Two months later i get a letter from finance comp telling me there was outstanding money owed i wrote back telling them i brought the car not knowing that there was any money owed as i was told no finance on it i also spoke to my solicitor who told me as long as i did not no there was money owed they could not take car back and then wrote to the finance company asking them to take the vehicle off there data as when i come to sell it would show there was money owed when i dont owe any money on this car and i brought it in good faith,also i did have a reciept stateing no finance and never been Damaged. When i sold car it was not showing on Hpi .. |

Agree SHOULD get it HPI'd, but I'm with you Bob, couldn't let it escape my attention. I'd hate it if it were me !! |

Yes just tell the bloke that you will drop him in it if he tries it on. Or advise the buyer to HPI check it if you get the chance. I favour the innocent would be buyer rather than the scam artist. Les |

The person who buys the car is protected under the consumer credit act, It's section 27. This will only apply to the first private purchaser who buys the car in good faith and without notice (unaware outstanding finance).
As long as you can prove to the finance Co that you were an innocent purchaser then title to the vehicle will pass from the finance Co to the person who has brought it. Lloydie |
Someone sold a car on SNet the other week, and me being nosey found some stuff on the net about the car that the owner neglected to mention.
Specifically he lied about the amount of time he had the car, service intervals and neglected to mention the fact that it had been in a pretty bad head on. None of this was disclosed but I did ask what the score was, never got an email back. Looked back at the evidence now and it has "gone missing" so to speak. Makes you think twice, even before buying on SNet. I suppose I should have reported it but never did. Feel bad actually |
