From Monday 1st December 2003, a new law comes into force making it an offence to use a hand-held phone, or similar device, when driving.

The penalty is a £30 fixed fine or up to £1,000 on conviction in court (£2,500 for drivers of goods vehicles, buses or coaches). However there are plans to increase this to a £60 fixed penalty plus 3 points on your driving licence.

So what constitutes a hand-held phone?

According to the Department for Transport, a hand-held device is something that "is or must be held at some point during the course of making or receiving a call or performing any other interactive communication function".

A device is "similar" to a mobile phone if it performs an interactive communication function by transmitting and receiving data.

Likewise, it will also be an offence to use a mobile phone with an earpiece if the phone has to be held at any point while you are talking or while make the call.

And you cannot use a mobile held between your ear and your shoulder.

The use of a mobile phone is also prohibited for texting and internet access if it must be held to be able to operate it.

What you can't do:
• You cannot use your phone if at any point making the call involves you actually holding your phone - even if only to push a button to dial or to receive a call.
• You cannot use your phone wedged between your shoulder and your ear.
• You cannot use your phone with an ear-piece if at any point making your call involves holding a phone.
• You cannot use a hand-held mobile phone even when stopped at traffic lights or in a traffic queue.

But the use of two-way radio equipment (unless the device can also be used as a phone) is not included in the new offence - although there is still a risk of distraction and prosecution under other powers.

Hands-free equipment is not prohibited - that means pushing buttons on a phone while it is in a cradle is not covered by the new offence, provided you don't hold the phone.

But be warned - you can still be prosecuted for failure to have proper control over your vehicle even if you use hands-free phones when driving.

If anyone wants one I have a Motorola Bluetooth Headset which I dont use anymore (fitted a full hands free kit).

Cost me £95.00 open to offers or bits for a MY01 WRX as mine is still standard.

Just a thought. I'm told the Nokia 7250 and 7250i aren't bluetooth compatible ?? Step backwards in technology, but I can't find any option on mine :rolleyes:

for those without bluetooth, there is a bluetooth solution that plugs into the bottom of your phone (I've checked with a 7250i at least). The bit at the bottom of your phone connects wirelessly with the earpiece, giving you the same effect as bluetooth.

I think it was £80 at The Link. I bought a simple personal handsfree, but the wire is really annoying in a car, it gets tangled, and then falls out everytime you turn your head.

That's a bit harsh. I wouldn't have said he was advertising commercially ??? I would have said that he was suggesting that he could do a good price on the group buy!! I didn't see him sending us to his website address or posting phone numbers, etc
