Personal Number Plates - New owner
Hi all,
Recently brought a car with a personal plate, nothing special. Ive recieved the new V5 with my name on it and IVe got used to the number plate, and quite like it. What are my rights / legal position in keeping it ??
Do Number plates belong to the car, unless on retention / V173 form or something.

Plate is on the car.You own the car .The situation you find yourself in depends on how mad you are concerning the the untold bump the car had . If you feel its justified then it seems to me there is not alot the previous owner can do .
A couple of things,
1) you are legally entitled to keep the plate as it was sold on the car, If the seller wants it back it will cost him £105 all in to have it out on a retention certificate.
2) That is not a legal number plate R6 UPI, they do not have the letter 'I' in the letters on a UK plate.

in a legal sence, the plate is yours full stop, he should have changed it first. The DVLA are very clear on the point in their paperwork.
on a moral note, if you said he could have it back then give it back to him, as long as he pays the transfer fee which will be £125 to put it on retention for a year.

A couple of things,

As said above if he wants it he pays the transfer fee and also your insurance charge as they charge you to update the system when you change numbers

disclaimer the £18 is insurance fee lol
i got pulled for incorrect spacing and was told by the police if i didnt fix it they would report me to dvla and they can revoke the number.
back on topic though, you told him you would give him the plate back so do it.
you should have checked the car out properly before exchanging money

Rear smack, new bumper, load of clips lost, bent metal behind bumper. To be honest, thats more my fault as its buyer beware. However, I did ask him if anything had been hit, I still would of brought the car etc.

However, I did ask him if anything had been hit, I still would of brought the car etc. It was raining when I picked it up ( again my fault ) and when dry you can see the corner has been mopped to about an inch of its life and the laquer isnt very good. I will need to get the corner resprayed £200 or so.
To be honest, I dont care about the gentleman's word etc now, Ive decided to keep the plate and wanted to know my legal position. I like the plate and want to keep it. He should of removed it before selling, so more fool him. There is nothing in writing, or email that confirms the return of the plate.

if you agreed to give him the plate back and you dont i would consider you an arse hole.
you didnt spot the damage on the car and as you say its buyer beware.
why not contact him and explain the rear bumper issue and maybe an agreement can be reached especially as you have his plate.
legally you can keep the plate
morally you're a ****.
as said before, ring him and explain the damage to the rear and see what he says, he may offer some cash to fix it as you still have his plate.
keeping it because you like it after promising to return it is wrong.

The legal position is that if you made a verbal agreement that he could have the plate back if requested then in law there is a contract......... just a bit tricky for him to prove in court unless he reads this thread

It's yours now.
It's up to him to ask for it back and up to you to decide. You don't need to do anything proactive.
I sold a car once without transferring the plate, then left it a bit too long and didn't get it back. Became worth more once AMG started using the designation - I basically gave away S55 HOT
