if dodgy directors etc like the fraudsters who ran Farepak thought they may actually face some sort of sanction then maybe they would think twice
Stanford only turned himself in when they issued Criminal Proceedings against him -- prior to that it was just civil

But were the Farepak Directors guilty of fraud? Or simply incompetence?
There are some examples of white collar fraudsters such in London, like the Madoff case, that have been banged up. At least five in one scheme over the past year. With warrants out for more arrests on that case alone.
From a criminal perspective there is a big difference between fraud and stupid or incompetent.

do you remember Saunders of Guinness fame -- convicted of fraud, but convinced the establishment he was suffering from dementia, but the day they let him out after serving barely 10 months he was dancing on the tables of a Nightsbridge restaurant -- the only known case of a person recovering from Alzheimer's disease
Scandelous -- and as i said, old boys club rules applied
well fraud/incompetence is certainly a fine line in the UK, less so in the US as the Natwest Three found out

i,m not sure thats the way it works in the States -- I think they are tougher, much
150 years for Madoff and the Prosecutors are going after the Wife and Sons now
in UK, if it ever gor to court -- the FSA has a pitiful record in this regard
a slap on the risk, "you've let the side down" and 3 years max

The things they get up to in corprate America are a joke, those companies who have good relationships with the Bush administration have robbed the American tax payer of billions and will never face a trial. Things here are 1000 times better.
