Question Drinking & Driving

Had a discussion with the boys at work today as whether it is legal to drink a can of beer etc whilst driving.Treating it as refreshment the same way as a can of coke.You would be very unlucky to be over the top as regards drink limits but how would the police view this.I dont know the awnser.They are always asking me questions and i normally have a awnser for them,but not this time.JASON

I imagine it is legal, but frowned upon, even I would frown upon it and I'm currently on a dd ban lol!!

people have been prosecuted for eating a kit-kat, so I'm sure they could do you for driving without due care and attention or something like that. They couldn't do you for drink driving though I doubt without you being over the limit.

From what I recall its illegal to even have open alcohol in a car even if its not the driver doing the drinking.

The only thing i can think of is the police normally ask if youve had a drink in the last 20 mins before they test you so i suppose you may have to stand around for a while for the time to elapse?

I used to down a can of stella on the way to a night out whilst driving. Can't imagine the police would like seeing you swigging out of it. I think it count as undue care and attn. So just be discreet.

A policeman warned me for drinking in a car, even though I wasn't driving. In fact, I wasn't the driver.

Not completey sure but i suspect you coud be asked for a breath test if the officer even suspects - which you could of course refuse..............IS it worth the hassle..!

I dont think you even need to be actually in the car if you have the keys

had almost exactly the same conversation with my mates about this the other day. a mate of mine normally drinks a can of strongbow on route to mine before a nite out.

would do you for driving without due care atleast!

its illegall in whatever state they were in on Dumb and Dumber i know that much!

Try telling that to the poor sod being cut out of a wreckage after being hit by a drunk driver, I myself was trapped for over 3 hours and very nearly lost my life to some prat who thought it was clever to drink and drive

I doubt people who drink drive think it's clever. Even now I don't think it's as bad as everyone makes out. I'm a better driver half cut than most sober people.

Just because the odd few spoil it for everyone does not mean it's that bad. Of course the goverment will ban it, that's because there are morons who crash their cars because they are so bladdered.

Not a good idea to refuse a road-side breath-test, as you will definitely be arrested if the Officer suspected alcohol (which he would if he had seen you drinking )

If you also refuse to provide a sample down at the station, you will be charged with this, and automatically disqualified if you are found guilty.

I asked one of the resident feds on here on the five-0 website, and this is his reply, Dear Pratt, you are one of this worlds most stupid and inconsiderate morons. You do not deserve to have a driving Licence and, just imagine how you would feel if some sad git like yourself was to drive with too much alcohol in his system, thinking like you he was big and brave, drove into your mother or your sister or your wife and maybe your kids and killed them. Well I can assure you that if you were to do just this, coz you will, you will go to prison for a very very long time, and your precious little japanese scooby blinking doo will be auctioned off and sold to perhaps a nice little chav who will run it into the ground and put silly little lights all over it, then blow up the engine. Thank you for listening and grow up...Pratt.

In Montana, it's perfectly legal to swig a can of lager or nip at a bottle of single malt whilst driving as long as you're not over the limit!

It's also legal to fire a gun from a moving vehicle which might go some way to explaining the above law...

A woman was prosecuted sat at traffic lights drinking from a bottle of water so I'm certain you could be done for drinking a can of lager while driving.

Yeah i know what you mean. In my younger days i used to drink quite regularly in a place that served halves as it had a Europen 'flavour' to the place. I used to count my personal 'limit' as between 4-6 halves of lager, and maybe about 4 reefers. I did get pulled aver a coupl of times and even though i was driving at the speed limits and felt in myself sober, i must admit that you brick yourself when you have had the equivalent of 3 pints, especially when you've been banned before. The skunk just adds to the whole hectic-ness but at least they can't detect that.
