Question Laptop

ill briefly explain the scenario here.
ordered new laptop. delivered but faulty. sent back to be repaired. long wait for part, so i demand a new one. new one delayed so i get part for old one eventually it gets fixed and i get it back.
all good so far except for the delay...


...new one turns up

no fone call chasing it back for a week now....what happens. how long are they entitled to demand it back for. 1, 2, 6 months ??

what do u lot think about this ?

I believe that you write to the seller and ask that he removes the item within a reasonable period (say 7 days). If he doesn't I believe it's yours.

If the goods were unsolicited then you could either say nothing and safely store them (not use them...) for a period of six months, after which theyd become yours, or you could write a letter as mentioned above; after a period of 30 days if they werent collected theyd become yours. Im not sure that this counts as 'unsolicited goods' though so you need to seek legal advice rather than 'ScoobyNet' advice, whichll probably see you in magistrates court quite soon...

hehe thanks, jus thought some initial advice would be handy. its a 1300 quid machine were talkin about, and the delivery was signed for by the way.
ill have to have a think about things

thing is if i dont hear anything say in a month, and its still sittin in the box in my living room, could i sell/use it ? ?

Being serious Id say that you could use it because it was supplied as a warranty replacement; but you shouldnt use your original kit too.

Theres nothing stopping you from selling whichever machine you choose not to use either, but it will still belong to the supplier and if they ask for it to be returned then youre f*cked! Id seek legal advice because the Unsolicited Goods and Services Act 1971 that people usually mis-quote doesnt really apply here..... Id guess that you could only dispose of the kit after making reasonable attempts to make contact with the owner and the owner will be able to claim the proceeds of the sale within six years

Wasn't Tiny computers was it? They did this to a mate of mine once with a laptop and when he informed them the girl on the switchboard told him to keep it!

I believe so yes; and the example thats used is: 'a friend left his yacht on my driveway for a few weeks and its still there 3 years later and Ive lost touch with him...' This is becuase the example is large enough to be a real hindrance and the owner cant be contacted. Where the item is small and the owner can easily be contacted then I dont think that the example applies. Whichever is true after six years it would be 'out of time' and youd be clear as long as you could establish that your selling in the first place was necessary; 'I wanted the dosh' falls short here Im afraid.

bearer of bad news, Dell's ordering system is pretty sh*t hot from my accounts, at work we had some parts delivered for some PE servers, the engineer didnt come and fit them so we did it ourselves and bagged the bits up to be collected, next month we got an invoice for them !!!.


Mother in law ordered a new pc and it come with a free AIO without usb lead, was an extra £10 for the lead, I told her not to bother as i have loads of the stupid things. It turns up and has a usb lead in anyway, the next week they send her a invoice for £9.99 for the cable and a envelope to return it if she didnt want it.

you may be lucky. but i wouldnt hold your breath

It that case it's probably my new one. Which was ordered online on 2nd February, and faxed confirmation sent on the 8th. I was hoping it would arrive on my birthday on the 17th. It didn;t and I called them yesterday, only to be told the order has been cancelled for reasons unknown. I am now waiting for a call to tell me if they are going to reinstate the order!

My guess is they will realise that you have two laptops, although Carphone Warehouse never realised they sent by boss two phones and 18 months later the 2nd is still in a box in the office in case they want it back.

Personally I would say that the 2nd laptop is not unsolicited as you asked for it in replacement for the faulty one. So I suspect you need to consider which ne to keep and sent one back. Or at the very least need to write to them asking them t collect the surplus one.
