As far as the law is concerned, safe overtaking is NOT a defence for speeding. The law takes the point of view that you should only overtake if it safe to do so staying within the legal speed limit.

In the past the IAM and police drivers taking observed drives would advise you to use the maximum performance potential of your car when overtaking so as to reduce the danger to yourself and other road users.

Since we have discovered that it isn't danger or bad driving that kills this advice has changed and you are now advised not to break the speed limits when overtaking.

This has seen some very cynical positioning of speed cameras, some of the worst I know are on the single carriageway sections of the A9 Perth - Inverness road. There are not many straight sections of this road but most have a camera positioned just where you would be pulling in after a safe overtake. We now have a situation where the road sees lots of "head on" collisions for some reason, I wonder why?

Yet another demonstration of why this isn't about safety. In saying that if such an event were to occur in England and Wales then the pepipoo PACE letter would be an excellent document to study and, perhaps, address directly to your local Chief Constable should you ever be entrapped in such a way.

I was in the very same situation. Frustratingly held up by a lorry at 45mph for miles on end but the only straight where safe overtaking can take place and talivan is poised for a nice little earner. 70 in a 60 and 3 pints - keerching!

I'd fight it on all fronts if it happened again.

yup,

it was about a year after my 3 pts for doing 33 i think

the 6 pts was by pc plod and his new toy at motram moor,
i was at the wrong lane, (need to be on left)
and couldn't break to get behind bus because,
a, car behind me,
b, tailback behind bus,

so 2 options

1, miss my lane, and do a u turn at some other road
2, try to overtake the bus,

so got to 38 got in lane, pc plod waved me in,
oh yeah i paid £250 fine too

oh well life sux

I do remember recently being out on an observed drive with a county road safety unit instructor, ex-copper for many years, IAM etc. Following a van for several miles, at points down to 25mph in a 60 limit. 1/2 mile straight comes, van speeds up to low 50s as I drop it a couple of gears to clear this mobile road block "You can't overtake here, you've only got 5mph to play with" OK, I was in a focus, but they can do over 60, eventually!

WWPS - there's something you are not telling us mate as that is unduely harsh and a huge fine! At least you had plod and not a machine I guess...that gives some chance of discretion/common sense entereing the room!

I got done doing 90+ in a 60 while overtaking a transporter on a nice dry clear day on a single carrigeway

5 points and £200 fine

Overtaking on single carriageways is a lost art these days
Having said that I was on, I think it's the A15 through Lincolnshire, and we're all at 40 and there's a stretch that's about a 4 or 5 mile straight with clear visibility and nothing coming. I decide to overtake 4 or 5 cars and get into that gap, still nothing so I ignore the gap and carry on. Didn't set off any of the cameras as I was doing 60 and so it carried on with still nothing coming so continue to the next gap ended up overtaking about 30 cars and a few lorries in one single manouvre.

You get beeped and flashed for overtaking one car safely, so imagine the aggro that caused, and not a single camera flash either

Oh and I was in a Bora, not a Scoob

Anyway, more relvant to the thread, I have overtaken notably above the speed limit then noticed the talivan, and never done for it, this was, I think, In the Lothian & Borders police force area. I think they take a few seconds to get lock on any one car, and it was quite possible that it was filming the lorry or had finished that and was reading the cars behind the lorry. They don't pan the camera that quickly either. I'd need to know the angles and distances involved to make a better guess though.

Which way did you slide? if you were side on to the talivan they might not have got your number plate

How soon after you pulled in did you notice the talivan? how far away was it, were there any other cars between you and the talivan? How long did it take you to reach the speed limit once you noticed the talivan?

Oh and which way was the van facing? and was it at the side of the road or an a bridge.

I am afraid that Meridian is right, officially you are not allowed to speed in order to overtake another vehicle.

If it was not down to speedcams and "by numbers" speedcam operators who will do you if they catch you over the limit regardless, in the old days when there used to be traffic cars policing the roads, the average cop would realise that it is far safer to overtake quickly and would turn a blind eye unless you were well over the top.

You have to hope he did not get a "bead" on you.

I'd panic if I was fired at by members of the talivan when driving up the A9... Barstads seem to get everywhere!!!

How long between you being visible to the talivan and you reaching a legal speed?

I could be wrong , but doesn't the highway code say you should overtake "as quickly as possible" :-)

It doesnt take more than a third of one second for them to target you and get a reading. forget about forming prior opinion, the scammers just point and fire at virtually everything moving- this is not a joke, I have a very interesting piece of footage showing a scammer van in operation.

The scammer operator will keep the laser on you to get the highest speed he can.

As long as you stay within the posted limit. Gone are the days of sensible policing, where you overtake by using maximum acceleration to limit your exposure to oncoming traffic.

I posted a similar Q on 5ive-o regarding speeding and overtaking. The law is you do not speed, if you need to speed to complete the overtake then you shouldn't. If you do O/T and speed then if caught it is down to the discression of the officer witnessing you overtaking.

tiggs - don't know what you drive, but some people do drive cars that get from 60-90 in a matter of seconds. it's all a load of bollox, we all know it, and it isn't going to change due to one thing - money. end of story. we shouldn't **** with any more of these threads.

This country and speed enforcement now all rubbish. When I was in IAM and an observer I was checked every year by a serving Police Class 1 Traffic Officer.
On these checks he told me to "stretch the speed limits" such that on A road 60 I would drive at 85 indicated and correspondingly faster on duals (no Mways).
Nowadays these speeds can get you points or worse!
But then this Officer had sense and told me 90(genuine) was ok for him on duals if conditions etc. alright.
I am not in IAM now. I left as a protest at the poor standard of Police driving when I moved to another part of the country.
I did write a letter about this to the then IAM Chief Examiner and he replied and,inthe main,agreed with me!
