Was in a car accident earlier today in my company van - nothing that serious, all Im suffering from is a stiff neck.

Now Im as against this claim-culture as anyone else, but if the insurance companies decide I wasnt to blame at all then I'd probably be stupid not to claim for whip-lash?

Anyone know anything about this, obviously someone else needs to be at fault, but do I need to have visited a doctor within 24hours of the accident or anything like that?

 

I'm against it unless I can get some money out of it

will the stiff neck stop you from working? if because of your accident you are going to lose earnings then yes claim, if not then dont because you and everyone elses insurance will keep escalating from bull**** claims.

May consider seeing the Doc if you consider it serious enough, if you don't feel the nees to see the Doc then you don't have a claim. If the Doctor tells you are a melingering hypocondriac then I guess you don't have a claim

Or you can be party to all our insurance claims going up.

 

Soft tissue injuries such as whiplash can take a few days to appear so it's worth seeing a doctor anyway.

If someone elses negligence causes you pain and suffering that should be noted when you fill in the insurance claim as it is a simple fact of the case, just as vehicle damage, loss of earnings etc is.

 

One mans light scratch is another mans gaping wound.

I'd go to the Doctors and get it looked at, whether you claim or not is another matter

 

I heard that once you had claimed compensation for whiplash received during a collision, you couldn't claim later in life if you needed to, for whiplash sustained in another accident as the insurance company would attribute it to the earlier injury and say that you had already received compensation for the "complaint".

Now I have no idea if this is true or not: After all, if someone breaks your leg and you claim compensation and then 20 years later it gets broken again - it's a whole other injury/incident surely...?

Can anyone clarify?

Pete, unfortunately the blame culture has arrived, and I think something is going to be done to cap the damages awarded to people, but if I were involved in an accident, I would play the game (everyone else does) - we pay enough insurance - why let everyone else get the benefit in damages claims? You can go to a doctor, but if you decide to pursue a claim, you will generally have to go to a medical arranged by the claims handlers, as that will be seen as unbiased, and will be what the damages awarded are based on!

Seriously - the b4stards that she has to deal with who make the ailments up, and get loadsa cash - makes me wonder if its worth trying to avoid muppets on the road, or let them crash into you, and get some money outa it (and some new car parts for free!)

 

unfortunately, quite the reverse is true. the doctor will say "you are obviously a malingering hypochondriac, here's a sick note for a month off work - you will be able to claim it back off the other guy's insurance."
