My wife is due in court for speeding tomorrow for 91 on the motorway, I am going on her behalf but she has lost her license!

What should I do?

Not much you can do.. fess up and admit you've lost the license and apologise for any inconvenience.. Courts like contrition..

Do you mean she has lost it as in cant find it, or lost as in had it taken off her ?.
First one, no probs just tell them she has lost it and you have so many day's to submit it to the court after sentencing to have the points put on.

If its the second, well lest said mate as she will get done royal style.

If the courts have told her to attend, there will be a warrant issued for her arrest if she doesn't appear. You can't go in her place, if she has been summonsed, but you can go with her.

The thing is her car is my name so the summons is for me, then I have to explain that it is used by her and it was her driving

The annoying is that the first bit of correspondance about this was the summons! which contained a copy if the nip which never arrived.

so you havent been officially spoken to by the police prior to the summons, what happened to the fixed penalty??, sounds like youve missed out on some information prior to the summons, thats probably why you have been summonsed, because they think you dont give a toss

did the summons arrive within two weeks?

If not you might be able to go down the route of them hot having served NIP on you within two weeks of the offence

No it was actually her in her xsara, and I have no need for someone to take the points because my license is clean (miracle)

I was implying no such thing mate This obsession with bloody speed makes me increasingly mad! Just had a huge slide on the motorbike just by a speed camera van - hope it took a picture of the diesel on the road too and the bikers breaking the limit sliding down the road at an outrageous 60mph on their *****! Still a bit shaken!

Its a 50mph limited, 3 lane straight bit of the A3, no schools, no houses, no shops, no traffic lights, slip road junctions etc - PERFECT for the Persecuters...

Question

Get a lawyer, if the correct procedures have not been followed by the CPS you could get this thrown out of court. It seems a bit strange to recieve a summons with a copy of the NIP?

What are the charges on the summons?

Well I do not know if its true but if you did not receive the NIP that means you didnt sign it so its not admissabe evidence, Or so I have been informed. Take a look at this site it may help.

Also, if the car's in your name and you didn't return the NIP, how did they get her name to put on the summons? Or do you mean you've been summonsed for speeding? If so, they can't have any evidence that you were speeding. Why the f*ck have you left it so late before doing anything about this?
