Stats show the second week in Jan is the biggest spike in request for divorce lawyers / social service related marital problems

The curmudgeon in me would ban Xmas, it puts such a strain on everyone

The peer pressure to "perform" whether that is presents for the spouse/children or to smooth over any "cracks" in a relationship etc is immense

depending on if it has changed since my split 20 years ago, the parent who the children are living with at the time of the split (i.e. dad leave house, mom takes kids somewhere else etc) the parent who has the kids has the main parental right! even if it's wrong lol.

But they should listen to the kids and what they want how much they take it into account is anyones guess as there are often allot of things said to the kids by the parents.....personally going to court and having it ordered that way was the best thing I ever did with my split.

No such thing as 'parental rights' for any particular partner.
Each is judged equally.Unless one is a complete druggy,psycho or criminal etc. & deemed unfit to look after the kids.Even then they usually have some limited rights.

The opinion of the kids will be taken into account.Hardest decision in the world is to try & be dispassionate & make the best for your kids.Your the adult.You created the problem not your kids.Make the call even if it hurts you the most.

Eventually you will reap the rewards & so will your kids.

Not withstanding Xmas, I still think the pressures on family life are crazy these days


And as above, I believe the children's best interest (however that is worked out) come first

Obviously (I would imagine) the older they are the more their wishes count

Sorry to hear that mate, both kids are of impressionable age, ope it works out for you and them.

know it is difficult, and dont know your situation, but if you and mum can keep it civil it is the best for the kids no matter who they end up with spending most of their time with.

been in family court ireland and in england no matter what they side with the lying ***** of a mother . one time i went to collect the daughter el cunto said i was spending too much time with her slammed the door closed brief n court cases she did this every year just to spite me i always paid too the morale high ground but everytime we went into court they gave that witch whatever she wanted

Traditionally this has always been the case, as the man worked and provided and the woman kept house and looked after the kids, but times have changed.

If we are now in a society where companies are being forced to declare wages and benefits for all workers, to prove that all are equal, then the same should be applied to custody matters, should they not, who is to say that a mother will do a better job of bringing up the kids, but there does still seem to be a bias.

I now this may see like a rant, but if we are going to all be equal then that should be on all counts.

Me, I have always paid the mortgage and all the bills, so would obviously have to move out and live in a bedsit so she could not be disadvantaged

Sorry to hear about your situation mate, I'm no expert but one thing I will say is you do right by not leaving the family home, as the moment you do that you're screwed.

Hope you can get this sorted, and the best way is amicably. Maybe start with having them for longer?

In my experience, (that is, with others), the ONLY people who come out of this sort of thing smiling, once you involve the courts, are the lawyers.

And lots of mud gets slung, some of which sticks. Best to sort it out without involving the law.

Yes pal she does about 20 hours a week , early starts so little one has to go to breakfast club then every other weekend she works as per rota and I've got him.
I'm self employed so can work around pretty much anything

I'm not generally a big believer in couch-therapy, but by the sounds of things this could be one instance where a shrink could really earn his/her pay. I mean that in the nicest possible way, you might be doing your kid a real favour for later in life if you tried to get to the root of the problem now. Best of luck with whatever happens, anyhow.

thats to your advantage then neither of you will get legal aid then, when my mrs took my kids she got legal aid and i didn't my brief asked me if i could afford to take the kids to disney i said no, he replied in that case you can't afford to get them back

Sounds like your boy is spoilt. He needed a lot of attention when a baby & you have let it continue.

Then you have a massive row in front of the kids calling 101 & shouting kidnap!!.

Your the ones who need therapy.You need to get some family counselling before you completely screw up your kids.

Outrageous behavior.
