Default xbox saves

Is there an easy way for me to transfer all my saves from my 20gig hard drive to my new xbox? I don't want to buy the £15 lead as my old xbox is dead.

Can I not just rip the drive out of the packaging and fit it in my xbox and upload the saves to xboxlive? or will that ban my console?
