Default Upgrading to Tiger

My girlfriend's ibook is currently running the 'Panther' variety of Mac OSX but she would like to upgrade to 'Tiger'. Not knowing much about Macs I thought I would ask SN

Now apple seem to want about 80 quid direct but theres an absolute stack of 'used' software on ebay for about half of that. Is it legitimate to buy this software and will a second hand copy work with regards to licensing etc?

Mac OS X does not use serial numbers or product activation so provided you get a retail copy rather than restore discs it will run.

Now, getting into actually being licensed... in what circumstances could someone legitimately offer a copy of Mac OS X for sale? If they are selling a Mac and have decided to offer that Mac in factory condition, ie. carrying the copy of Mac OS it shipped with. The "second" copy of Mac OS for sale will therefore have been uninstalled.

"Family Pack" licenses all have to be used at the same address so these cannot be re-sold individually.
