Unhappy Drink Driving Penalty In Scotland

No, not me.

Touching a nerve here but I said I would find out what I could.

An aquaintance of a friend of mine (honest!) was rumbled the other night at 01:00 after having consumed some drink previously.

His test - breath, blood or urine, I'm not sure - showed 72 mg / 100ml.

I think the threashold is 35 mg?

He has a young but unblemished licence; what's he looking at?

Bear in mind it's Scotland, so Magistrates don't apply.

In Scotts Law min 12 month ban and possible resit of test after.

They got me off a speeding charge just by using the law against itself.

everyone i know that has been charged with drink driving where i live has had a 12mth ban + massive fine (700+). i live in the highlands of scotland.

What happened to the imposter? Get nuked? Good!

Pete does bring some valid 'alternative' ideas to the forum. We haven't go to like or agree with them, but judging by the usual responses they get people talking/thinking which is what i'm sure he intends.

Don't get starting a fan club yet PSL, but this place would be poorer without you.

Depends where he appears in court - different Sheriffs have different standards. For example in Shetland (Lerwick Sheriff Court) there have been four figure fines in the past year. Other courts are more lenient. A minimum 1 year ban is mandatory.

Why was my reply taken off? Could it be that the mods on here condone drink driving? If any of them had seen the results of DD then they would have left my post alone!!

One year ban without a doubt.........then think of a number and double it for the fine......i'll guess about £400

I'll advise my colleague to tell his M8 to start looking for a good price on mountain bikes at Halfrauds.

Just had a member of my family who got caught the mornin after the night before.....still got 12 month ban, fined and made to take a medical before getting licence back.

I think in a lot of cases you have to do an extended retest after the ban as well ? something like an hours driving, and you can only make a few minor mistakes.

Without being judgemental, wouldnt bother even taking the risk myself - thats what taxis were invented for !

Matchmaker, that's where I live - there's been a serious crackdown on dd in the last 12 months. Last I remember there was around 80-90 folk charged in 2004 out of a population of 22,500. Pretty sure that's way above avg. There's been a number of fatal RTA's in the past couple of years that involved dd.

p.s. damn good gatso'less roads though...
