if oil level is a bit over 'max', could this cause the rear crank oil seal to leak?

I can't see that only a bit over will cause a leak on a couple of inline 4pots i'v worked on you are talking of over fill by 30-40 mm before the rear seal starts to leak plus they were smoking like good ones. Sorry to say you might have damaged the seal.

Dixie.
