Country's are bound by Geneva Convention not individuals. He broke the rules of engagement and/ or the law . These rules are made quite clear as early as basic training and are often reminded. Trouble is there can be grey areas. It's not always possible to take prisoners while on ops as it could put you in danger or seriously detract from the mission. The fact the insurgent was wounded could compound this problem. The grey area lays whether you should just leave him and whether he could still be considered a threat if left alive. I have not followed this case so am unaware of the details. War is a dirty business but our troops are tasked to fight it in the cleanest possible way.
What sealed his fate was the defence said they were still in danger yet the video clearly indicated they didn't feel they were.
Wthout the video I doubt he would have been convicted. Whether this is right or wrong is up to people to judge for themselves.
The saddest thing of course is that we shouldn't even be there anyway. This was a conflict the Americans started and Blair and then Cameron decided we should be part of. There is no end goal, no way of 'winning' as such. As the British commander said last year the best we can hope for is we leave the country no worse than it was before we arrived. Has it really been worth all those deaths of British servicemen. I don't think it has!

I assure you that soldiers from our country attacking another country does not make me feel any safer.
I am more at risk of being stabbed to death over my phone from our indeginious population than I am from any apparent terrorist who has never even attacked our country in the first place!

I don't wish the murder of any human being, especially not in cold blood. I have to agree with Scarey about not letting our Country drag down to their level.

As the man was already gut shot full of holes from 30mm high velocity cannon shells, I think the whole thing is arbitrary anyway. War is full of stories of people being shot to end their misery and no comment.
If the guy was spotted 30 feet away they would have plugged him and no one would have said a word, apart from "good shot Soldier".
You can't go around arming people with the intention of killing, then expect them to turn their emotions on and off like a tap. Perhaps some of these paragons of virtue who expect chivalry on the battlefield would like to have a go themselves and report back how they get on.
We need killers to do our dirty work, not bleeding hearts, and they deserve to be backed up by all of us who don't want to go there.

As has already been said as we signed the Geneva convention our troops have certain responsibilities and rules to stick to. Correct me if I am wrong but Afghanistan and Iraq haven't signed the GC so do not have to stick to these rules.
This means we are fighting an unfair war against an enemy who can and have stooped to levels beyond law and morals.
Having listened to the recording what stood out to me was the "Who wants to give this **** first aid". Am I right in thinking that troops are expected to patch them up if they wound one? Is it likely that soldier would then go home and think twice about his actions or instead go back, back up another AK and perhaps wound or kill one of our boys?. I dread to think what would happen if Taliban wounded and surrounded one of our soldiers.
Being in the spotlight gave the judge no option really, and I'm sure its not the sentence he would have liked to have passed down.
