I dont think being held back and making a few gestures will see him convicted of affray.
Looks like he got hit first which explains his Barristers self-defence argument.
Not sure if we have seen all of the CCTV yet though

Being held back can not be classed as self defence. It might not be an affray, but a decent S4 (threatening behaviour)

This is exactly what I have seen weekend in, and weekend out for years....

It doesnt make it right, but it happens....often.

Gerrard did nothing to warrant him being in court.

How many of the thousands of drunken brawls I have seen were nobody was left hurt ended up in court, none to my Knowlage.

Now its a different case if someone is hurt/left unconscious/scared/disfigured, but a split lip and a black eye, from a guy who threw the first punch or half push as it was....come on.

The lads who waded into him after Gerrard was pulled back will be held to account, Gerrard will walk away.

And what do you think will be handed out to the lads who have pleaded guillty, exactly **** all....what a waste of time and money.

He is charged with Affray not a minor public order act offence and thats what the jury have to decide upon.
Im guessing the self-defence argument will apply to justify his subsequent actions

surely the whole sorry episode hinges on what music he wanted to put on the CD player

anything by Amy Winehouse, Blur, Lilly Allen -- guilty as charged and he should do time -- big stylie

but, on the other hand if he wanted to put on a spot of Neil Diamond -- let him off whith a very mild rebuke and "an on your way sunny Jim"

Gerrard came from a rough **** estate in Huyton.
His Nan lived at the back of our house. Now she was a story just in herself.
Baggy Barbra.....

Gerrard as a kid was a little T*at, and don't think his fame and fortune has changed him one bit.....

The point is though is that its wrong and against the law. Loads of fights go on and only some come to the attention of police (either witnessed by the police, the pub staff, the victims or most get reported the next day by the victims after they have had time to think). If a crime has occurred which is brought to police attention it has to be investigated. The only reason it has gone to trial is that they all went not guilty.

Whatever punishment is handed out will depend on their individual history, but it can carry a jail term.

It can not be self defence. Self defence is where you hit out to protect yourself and once the danger is passed you back down. Being held back by your mates is an obvious sign you are on the attack and not in any immediate danger.

Based on the CCTV footage, affray looks like the appropriate charge, but they might plea brgain on a lesser public order offence (threatening behaviour)

As a United fan I'd find it amusing if he went down but unless it was anything other than pushing and shoving and they have concrete proof he battered someone what's the point of taking this to court, far more serious issues on the streets these days.

I really believe the law doesnt truely reflect real life anymore. Everything in law is black and white, when in truth life is grey.

How come silly little pushy pushy fights like this go to court, but known drug dealers, gansters, criminals get away with everything ?

I appriecate that laws have been broken, therefore prosecution take place, but from the general publics point of view, it gives the impression that p olice seem to go for the easy, cctv capture, Mr Meaner crimes, than the harder, more serious ones.

As a tax payer, I feel this is a complete waste of court time, money, officers time, when the results will be what ? a fine ? All these resources could be redirected into other more serious things like murders, rapes, drugs.

To the guy who got pushed, instead of going to court, he should be told to man up.

Society has become a bunch of girls, all suing, claiming, poncing, and never taking responbilty for themselves. God knows how it will be in the future, I so worry about my 6month old son, what will this country be like in 20 years time ?

We do attack other crimes such as rapes, murders, burglaries etc. If the evidence is there, then it goes to court. There are loads of cases such as these that you won't be aware of as they are not in the media spotlight. Or most plead guilty from the off as they know the evidence is too strong.

At the end of the day, the person who was attacked in the bar (or others) have a right to have the incident investigated, and if that investigation proves his case then it will go to court.

Believe me fights in pubs will not be easy to investigate - the number of statements and interviews this will involve will be imense - it wont soly rely on the CCTV.

I appreciate it will cost a lot of money, but so does legal aid etc which most of the scum use all the time. We can't just use the case of "I'm sorry, we can't investgate this crime as it costs too much" Does the argument still hold for the burglar who steals a purse containing a few pence.....?

Just saw the new released footage of Gerrard grabbing the mans head and punching him 3 times.......This after the victim was elbowed in the face, Way to make a self defense claim Gerrard.

From a professional point of view he has NOTHING, his brief seems to have been lead by him rather then him lead by his brief. Only a technicality will get him off this one.
I cant for the life of me understand why he didnt just take the caution for affray, He could be talking 6 months for this one now.

I dont know what CCTV footage your watching.

McGee was elbowed in the face by some lad who was in Gerrards group, this was after Gerrard had asked McGee to sort the music out, and they were face to face.

Gerrard was then pulled away, the girl sat to Gerrards right at the bar (blonde hair) is the best witness in the group.

McGee says Gerrard hit him with a boxers barrage of blows, well with all due respect to him, how the **** would he know he had just taken an elbow to the bridge of his nose, and when the barrage was given he had his head down anyway.

You can actually see in some footage Gerrard being held and dragged away as the blows are delivered.

His self defence claim will be decided by the jury not Felix...and it is a defence to an affray charge..cant plea bargain now either since a crown court trial is underway
Timwinner....a caution for affray..was he offered that??Cant see it myself unless you know different??

When he was arrested he would have had the chance to plea, take a wrap on the knuckles and walk away. He has the money to get a good enough brief to sort something out. You talk like you know about these things so I am sure you know how things work behind the scenes.
If you can avoid doing a full file then you will avoid doing it for something that on the grand scale of things is fairly minor.

He sounds like he is taking advice from his agent or his ego is leading the way. If I was prosecuting with evidence like its suggested is available I would hang him out to dry, any any brief worth there salt would be able to identify that.

This could have been nipped in the bud, He could have gone for a sec4, a common assault, if he was really smart maybe even a breach of peace.
It didnt need to get to this, and now it has I would put money on him getting no leniency from the court.
