fit for purpose .....YES

satisfactory quality .......YES

not inherently faulty at the time of sale....... NO FAULTS

Which means no Refund is due,

Any clearer for you now?

Im with Scooby Soon on this! 100%

A garment simply not fitting is NOT grounds for refund and is not foul of the sale of goods act. FACT!

Size Large, 12 , age 13-14 are also ONLY guides to sizes. It doesnt mean it will fit ALL 13-14 year olds how big is a 13year old! (pardon) or anyone who is usually a "large" how big is a large? Its a generic size guide. No two brands labelled "large" will ever be the same!
Its an ABOUT this big size!!!

If however it listed a 34" waist, 44" chest, particular collar size etc etc then yeah...of course it should be just that and you should be refunded. Its not as described.

If there is no changing room (i believe there was'nt one in this case) then "Rig" your entitled to a FULL REFUND otherwise its a credit note/exchange on a good will basis.

I hope this clears things up! You ladies can stop argueing now

I would also like to add in agreement with SS that usually if you approach the manager/sales assistant politely and even when told you cant have a refund keep your cool and dont start with the Im a solicitor, my uncles brother works for trading standards, i know my rights blah blah blah your much more likely to get the result you want. As soon as the threats/aggression starts you've lost! Not saying this was the case - just bare it in mind.

I'm with these guys, i sell computer parts and i have to give refunds every few days when people buy the wrong thing. Nine people out of ten are reasonable and politely explain the problem and i will have no problem sorting them out but if they mutter the imfamous words "trading standards" then they dont get **** all out of me.

Most people expect a shop keeper to poo one if they say that but in Stoke there are only 3 people who work for TS. You have to be a massive repeat offender to actually get them to take any action.

My simple rule is to just be reasonable. Hope she likes the brown
