But the thread starter in the thread I linked to could be lying about his knowledge of the car's history. Just like what is being implied here.

Just waiting for the report and valuation from subaru dealers near to me to come back, and a copy of a previously destroyed document.

jeez...... just another bod to pass on their condolences here!

whether the seller knew or didn't know that the car was in that condition doesn't matter, the fact that the car was in that condition means recourse against the seller (nice little civil action) and if the seller is clean and unaware thereself then they should have recourse from whoever they pruchased it from.

nice amount of buck passing your having to deal with!! i would have lost the plot along time ago and issued legal proceedings straight off.

Just look in the Salvage section in the back of autotrader and see a long list of wrecked cars with "Not Recorded" in the advert. Meaning, you buy, fix it and it'll still be Hpi clear.
I had my old car repaired by the insurance company and it does not show on the Hpi report. Big Tail end smash all boot floor replaced, but this was not recorded on the CAT register as the car was not a total loss.

It will only show on the HPI reports if the car was written off by the insurance company.

the fact is if you can prove the seller misslead you on the sale you have a case, and by prove i mean in writing, ie adverts receipts etc, if its by mouth you have no case

caveat emptor does indeed apply the only possible case is as above missdescription, find out who he got it from weather they told him its a write off, look for his other adverts, get a letter in writing fromt his chap who says he was offered the car recentyl asnd was told its recorded

If its dangerous you have a better case and that does not rely on what the vendor may, or may not have known.
