There was a bike behind me who followed me past the cars and then passed me and went away out of sight.

Two corners later he had hit a car head on overtaking another car. We stopped and he died at the scene within minutes.

It worried me at the time that some Maestro driving Mr Sensible could have said we were racing (we weren't) simply because we were doing over 50mph and daring to overtake him. To Mr Sensible a 911 and a bike going briskly - i.e. faster than his sight-seeing pace must be racing.

On the basis of the above conviction all I need is a couple of neds to turn up at the Police station and I am away for five years...

...or is there more to the conviction we are not aware of?
David,

Its for that very reason that I will always let a bike go first, even if I miss an overtaking situation as a result.

There simply must be more to this though, and my take is that however nice a guy this Darren is, and however accidental the incident was, whilst he may not have caused the biker's death, he is guilty of the Road Traffic Offence for which he was sentenced.

The worrying thing is, I suspect but for good fortune, many of us posting on this board could have been on a similar situation.

It is completely unreasonable that even if I was "racing" someone, if they crash and die trying to catch me, or two hundered yards ahead of me having passed me, that I should be held responsible for the persons death - but that is the current law on the matter, and a damn good deterrent to driving like a dick on the public road, to be fair.
