Its basically an excuse by subaru to kop out of there responsibilty.
they build the cars, and all the vehicles are given a warranty, regardless of where they are sold. this warranty should be honoured by subaru / im/ whoever you want to call them.
its just using any exscuse to evade reparing defective products.
when the cars come off the production line and are sold, subaru/ im get paid, end of story, if the dealer then sell it and undercut someone else, that subaru / im is business. you got the price you wanted. You are required to honor the warranty that went with the car.
find out where the head of im lives in the uk, and park your car accross his drive way, so he cant get to work, call the press and the bib and have a media frenzy, bit of bad pr is well loved by big multinationals!!

Its european rules that allow Motorpoint to import cars from countries that have a higher tax rate than the UK.
Figures for example only
i.e. Tax free price in malta £12.000 but a 30%duty means a retail price of £15,600
Tax free in UK £13,500 vat at 17.5% means a retail price of £15,600 (approx)
So cars are £1500 cheaper tax free in malta and when bought to the UK and have 17.5% added are cheaper than Subaru dealers.
Not illegal and not fair to UK dealers.
IM are simply using the same european rules to try to stop this anomaly.

A car has a cost to manufacture, no matter what the rate of tax in the country is... That's nothing to do with EU law.
The fact that cars, ex vat, are at least 1300 cheaper in Malta than in the UK means that someone somewhere is taking that 1300 quid as extra profit. It could be FHI that subsidise cars to countries like the Netherlands, Malta, etc and ramp up the raw costs to the UK.
Or could it be the official importers?
The IM Group is the largest private motor importer in the UK, and their CEO is Bob Edmiston. Mr Edmiston was at no 97 in the UK's rich list 2003 and was worth a meagre £343,000,000 or thereabouts. He slipped to a disappointing 123rd in 2004, worth just £352,000,000...
I may be putting two and two together and making 5, but I think I can see where some of that £1300 is going.
(BTW, In no way am I saying that IM shouldn't be making good money from selling cars, or that Mr Edmison shouldn't be taking what he wants for his hard work. That's not the point of this post)

The retail cost (inc tax) is the same in both countries (Excluding Underseal/alarms and the other bits)
Subaru have to price the car cheaper without tax so there is uniformity in pricing across Europe.
Otherwise they would not sell any cars in Malta as they would be too expensive.

just a thought to add to this thread.
if the car breaks down , regardless of warrenty the buyer surely has a the right of redress via "merchantable quality" clause of the sale of goods act.
pain in the *** and you have to take motorpoint or whomever to court but you should win if you haven't abused the car.

If Malta can purchase vehicles at £xxxx net cost then I'm sure IM with thier muscle are paying the same if not less.... remember IM import the vehicles with no warranty so there is another 'negotiation' point to drive thier cost prices down!!!!
At the weekend I am a semi professional musician, my gear can be and is very expensive, quite a lot of it I have purchased from retailers in Germany and France and shipped it in myself saving some 25% over UK prices. If I have a problem I take the item into the local service centre and it gets repaired or replaced, The UK importer doesn't moan that I bought it somewhere else in Europe, I have done nothing wrong, I have saved a lot of money!
Silver Knight.... you are defending IM as if there is something inherantly wrong with importing cars from other member states of the EU when.... in fact..... that's the whole bloody point of the EU.... (of which we are members like it or not!!!!!) to allow free trade and competition from the whole!!!!! Also importing a vehicle from other parts of the EU is perfectly legal and legitimate.
Now.... as I have said in earlier posts, on the face of it IM are doing nothing wrong in refusing to administer the warranties, they have identified a loophole that says a certain document..... a 1 sheet note, 1 paragraph long... must be in existence. Something which until recently no one had any idea about, even IM.
Now that everyone knows what they are supposed to be doing ('cos it's obvious that no one knew EU rules down to the punctuation prior to this coming about......) that loophole will now have been permanently plugged and any imported Subaru from your Motorpoints, Alliances, Virgins etc will all come with that piece of paper and IM will have no option but to do thier job and administer the warranties!
So that just leaves a few hundred of us in limbo who basically bought our cars at the wrong time and are suffering for it at the hands of..... IM
In the long run they will have achieved nothing more than to screw over said few hundred Subaru owners and really p*ss off a large chunk of the Subaru owning community..... There are alternatives out there and the price gap is narrowing..... Evo anyone?

Can someone explain what happens if you own a 'Uk' car,it breaks down when you are on holiday in Germany for arguments sake?
Will the german dealer say,'sorry i cant do anything because you didn't buy from the official german importer'?
Will he say 'yes i can repair it,but only after i have spoken to the 'UK'?
I think he will probably do the latter because he will still get reimbursed from IM,the same as if it comes from Malta/Cyprus.
The UK dealers will make money on servicing and 'goodies'.

I have had a response from Motorpoint after sending them a copy of my letter from Subaru UK and basically they are not interested in any kind of compensation at all. I don't know what to do next now without facing large legal bills.

no win no fee?? LOL
or we could all steal each other's alloys (due to the lack of locking wheel nuts on imports) and claim the £1000 back from Motorpoint.
seriously though, we could do a class action and split the bills if someone has connections to a decent solicitor, who won't charge the earth for a few threatening letters and a potential suing

And when (or if) we get our cars serviced at a main dealer, you end up paying labour charges, so Subaru UK are getting their extra off of us..
I wonder if any guys in the forces that brought Subaru's in the UK then got posted abroad get problems with their warranties..

I too have been monitoring this with interest as I have my sights on a MY06 import.
Without wanting to hijack the thread in any way, what exactly do you need to purchase a car from Europe and still get the 3 yr subaru warranty?
Cheers,

Don't take this as gospel, but it appears that if you either order a car from a garage anywhere in Europe, or someone brokers the deal on your behalf, then that's acceptable. Buying cars, holding them as stock and then reselling is what IM UK are objecting to.
Riiiiiiight. So because cars in Denmark attract a 180% luxury tax, the ex vat price there will be, oh, about 5 grand? That must be right, otherwise they would not sell any cars in Malta. Simply brilliant deduction, Holmes!

update
I found this on the What Car Web Site!
Subaru to honour warranties
16 December 2005
• Subaru will honour warranties on Euro imports
• What Car? pressure forces Subaru clarification
• Warranties completed by European dealer now covered
Following an investigation by What Car?, Subaru has agreed to honour warranties on cars imported in to the UK from Europe.
In October, What Car? discovered that hundreds of owners had no warranties on their new Subarus, despite having fully stamped paperwork. Cars purchased in Europe from third party resellers were classified as unauthorised sales, and Subaru UK stated that it was under no obligation to provide warranty cover.
However, following consultation with the European Commission and the Office of Fair Trading, What Car? pressed Subaru Europe to clarify the situation for the owners of such imported cars, believing they came with a full warranty.
Subaru Europe has now stated to What Car? that owners with warranty paperwork completed by a European dealer will have their claims honoured. Subaru UK has also told What Car? that it will process any warranty claims with valid paperwork.

Motorpoint had begun to offer buyers 3rd party warranties AFAIK.

This is an interesting development as i have just received a letter from Subaru Uk saying that i don't have a warranty.
Can anyone clarify what paperwork is needed as stated in the what car article to ensure that the warranty is honoured?
