if he aint got the right number themn nothing, unless

a: persons whos number it is was using there phone at the time
b: police get back in touch to get correct number

Hope he gets done, amount of planks I see driving on the phone hacks me off (have had a bump cos some plank was on his phone and failed to notice traffic stopping infront of him!)

And what is it with people who drive £60'000 mercedes and don't bother with a car kit.. saw some chap on the motorway with a phone strapped to his head in a brand new merc... Thats just daft!

If he gave them the wrong numbers, and the number is not relevant to any phone or do not match (IMEI to phone number), then I would imagine Police can charge him with providing false information.

They could then get the right numbers and charge him again..

I would imagine the copper would check, find the numbers to be incorrect, and would no doubt have taken a note of his car registration (unless he got that wrong!), would then know the driver had been lying, would know his address details and would probabaly nick him for trying to pull a fast one and getting away with it.

Probabaly not the smartest move (twice) he ever made...

i agree, dangerous to drive & talk on the phone, deserves to be nicked.

Perverting the course of justice is an imprisonable offence. It's what people get done for when they say it was their partner or a random untraceable "friend" driving the car.

So the choice is £60 fine & a couple of points or 6 months jail with Bubba - does your friend feel lucky?

Twice might be pushing it but once is "he misheard me or wrote it down wrong". This happens all of the time. They even write down the wrong reg numbers when they're looking straight at them or their writing is so screwed it is transcribed wrongly when entering details onto the computer.

There have been stories circulating of the Police using mobile phone records to nick people for speeding, using the time between cells to work out average speeds! lol... Personally I doubt that's true, but it's just one more reason why I turn my mobile OFF before I get in the car. For the life of me, I can't understand what could be so all fired important that it can't wait until you get where you're going. My Missus says she can't get hold of me, and I say "damn right you can't " !

I have a bluetooth car kit in my impreza, cost about £50 and fitted with a few plugs.. If my phone goes whilst driving I will answer it, tell whoever it is Im driving and will call them back later..

There is little excuse for talking on the phone whilst driving to be honest, and I believe the only time you get away with it would be if you were talking to pld reporting a drunk driver etc!

I completly agree.
A bluetooth headset these days is cheaper than fine anyway.
No sympathy from me.

While technically possible, I'm not sure how this type of evidence would stand up in court with regards to speeding. It's a lot of work for someone to do for the relatively minor offence of speeding; plus I'm not sure how the use of phone derived information for an offence like this would be dealt with under RIPA. I'm pretty sure that it would be on some very shaky gound with regards to what paperwork the officer would have filled out to cover, what is in effect, targeted surveillance (even in hindsight).

That said, the people who sit on a phone having lengthy conversations while driving are ****.

Spot on - worrying for the next couple of weeks in case plod turns up because you lied and gave false info - is it really worth it?

Not true due to the way mobile phone cells work. For instance, over the course of a mile you can jump from one cell to another and back again.

That'd happen if they were anything but useless, forget all the scare mongering that goes around here, noone will ever bother to persue this.

I'd imagine what will happen is the Police will check the numbers, realise they dont tally or are registered to someone different to the person who owns the car, and will be knocking on his door soon.

But I have to say it, is your mate a complete plank ? Its not exactly a secret that you arent supposed to use the mobile in a car, and that you will get done for it if they see you.

Still suppose it could have been better for him, he may have just mowed down some innocent pedestrian while taking his 'vital' call, and he could have just driven away

The amount of times ive nearly been side swiped on the motorway by some halfwit on their phone is unreal same goes for people texting, they spent half the time driving hiding their phone and looking down at it to text!

I dont agree with driving while using phones, bluetootch headsets are cheap enough these days or enough cars have it built in, but I think the police man was trying to scare you into not doing it again to be honest. Hopefully your friend will learn from this !
