02 Problem

Right got a Nokia N95 of them in August,now the handset is faulty (problems with freezing and speakers have gone).I contacted 02 and they want to send me a refurbished item as replacement for my faulty handset which I'm not happy with.What should I do as I would like a new handset as refurbished one only comes with 45 day warranty so after that no come back with the phone.
your phone comes with a two year warranty!! actually i think its three, but it needs clarifying.
check your warranty book, and then tell O2 you want a new phone back, and the remainder of your warranty honoured. (sale of goods act

All Nokia should come with 2 year warranty from new. Just find yourself a Nokia service centre (Carphone warehouse should be a safe bet) and take it there.
You should either get it fixed or replaced (but I do believe that they are within their rights to give you a refurb product)

The reasons I dont want the refurbished one is I have heard that they are not with out there faults and my warranty is then reduced to a 45day warranty from when I recieve it,so day 46 it goes **** up what do I do??
despite what 02 say, the warranty provided by nokia is 2 years.
you need to go back to o2 and tell them

Had reply and they are not going to send me a new handset but a refurb N95.Not happy where/what do I do next to get a new handset??.
