Just a few off the top of my head. Why a TD04? Surely TD05 unless it's a wagon, IIRC.

you checked the turbo carefully which you accepted as correct< i took the turbo off of my my94wrx saloon which i believed to have a wagon engine it is now obvious was a lagacy engine as far as im aware i sold you what i thought was a td04, which you checked as correct and accepted

There was no way i could check the turbo carefully at that moment of time and place. You know it was dark and put it back in the box and i had to rush only because i had a long drive back home.

I know what i was looking to buy, specifically mentioned in my advert "want a td04", but you didnt know what you were selling.
Also, you have mentioned recently that you had wiped off the id on the plates with blank ink, so ideally you should have known that it was a vf10 turbo and not a td04! So this is not a fair deal

So if in good faith you believed it was a td04, which its obviously not, you shouldnt have a problem refunding me my money

First you say that it you thought it was a td04 as it came off a 94 wrx
then you say you marked it off with blank ink so it could be read clearly
so at the end of the day, you knew you werent selling me a td04 !!
