Posting a picture on facebook = sackable offence.

Killing a 4 month old baby because you "got distracted" doesn't come under "gross failure" and is just a slap on the wrist.

Indeed. Post an ill judged comment on Facebook, get a sentence or a fine. Stand in a street in London with a load of others shouting death to all British Troops or behead infidels, nothing.

In fairness there was no intent to kill the baby, it was a gross mistake via malpractice and a badly administered and monitored ward. So prison IMO would not be the right judgement, suspended sentence maybe.

People who are offensive online rarely do it by 'mistake'. There is intent. Same as people who mouth off in the streets. It doesn't bother me if people like that go to jail, although I think it would be better served doing hard labour as part of a community service sentence.

Eh, accidentally killing someone is manslaughter isn't it?!

Ali, I don't think jail time is right but I can't rationalise how the other nurse involved can be returned to work in this unit. As terminator x points out it is a slap in the face that the only reason one of them has actually been fired is because she posted a picture of herself asleep on the job and the poor baby's incubator was in the background. That says that posting a picture on facebook is a more serious offence than simply not being up to the job.

How either of them (or whoever took that picture) can be judged not to have been seriously negligent and removed from this position of trust is beyond me.

None of all that excuses making such a serious mistake resulting in the death of that poor child.

I would be more inclined to call it manslaughter and deserves an appropriate sentence.
