Minimum wage and commission
 

I'm currently working as a sales executive (bull**** title) working on less than minimum wage hourly rate(£5.03 per hour) BUT it has an OK commission, what I want to know is can they pay me less than minimum wage hourly rate when I'm on commission or is it exempt due to the commission making my wages over min wage? If that alleles sence. :lol1:

They have to pay you minimum wage as if one month you don't make any commission, then you are being paid well below the minimum wage.

How long have they paid you below minimum wage? i would have thought that if it proves that they have to pay you minimum wage, then you would be able to go through employment tribunal and get back dated pay?

It's been like that for 2 years. Think I might need to have a word with the citizens advice bureau.

By law, you earn the minimum wage however they make it up. It seems a bit mean what they are doing, but they could say, with his commission, he is on more than the minimum wage. What would happen on a lean month, I have no idea. But, they would have to make up your pay to at least the minimum.
I think it stinks, they are paying you just above the rate for aged 18-21. But with your commission, it could easily hike it up to more.
Take a look at direct.gov for some hints. I would think if your hourly rate is 5.03 on your payslip, you could argue you are not on the minimum wage even if your commission takes it over.
Hope that makes some sense, I am useless at explaining things :D

Thanks Lee :thumb: yeah it makes sence, yes it's on my payslip what the hourly rate is. They've really pi$$ed me off the last few months with one thing or another, and I've looked at my pay with a bit more detail. I always make more than I would get on minimum wage, but it's a long way off what I was told I would earn when I started, thought the current economic climate hasn't helped. Needless to say I'm on the hunt for another job :)

After looking on the ukgov site it seems that commision can be included to make up the minimum wage :(

What company is that with ?

I worked for a family business when I was very much younger (in the 70's) and it is a double edged sword in that it's not like working for a call centre, the pay wasn't great but it was like, well, part of a family.........suited me at the time.

I've worked in a call centre, worked with good people, but the most boring un reward job imaginable.

TDW........the family business I worked for was a bike shop, not my family business as my mum was a part time dinner lady and my dad was unemployed for a lot of the time as the 70's was a pretty dire decade...at the age of 16 I paid a lot of the bills..............

I thought so, but the vast majority of Companies don't do it. Seems to me you are being exploited. :(
Might be worth having a chat with them, if they are a family business they might be more keen to keep you than a massive place where you are just a number. If you get no joy, time to move on. They are using the system, sorry

No point in speaking to the Boss about it he's too tight, it's time to get out. As for feeling exploited, I suppose I do amongst other things, but I know there are a lot of other people that arent very happy, the problem is there's not a lot of jobs about.

Still might be worth having a chat with him. Sometimes family firms have no idea of the real value of good staff. One of the Companies I work for was a farm, now turned into a paintball site, golf course, trout fishing and all sorts of leisure stuff. He has grown so much but still expected to pay people farm hand wages :lol1: He honestly did not realise. He does now and has a happy crew.
