How long does it normally take between getting arrested for Drink Driving/Failing to Stop to the Court Case and whatever they award?

I was thinking that it would be quick, 7 days? - but I'm not too sure?

Also, is it right that you can drive to the Court - but not drive away if banned ... or do they let you drive home? ie. the Ban commences the next day?

Who got caught? U? Is that the OBE out of the window now? :D

Depending on how busy the court is, 7 days is about average. You can drive there, but not back if banned.

It's not uncommon for a marked car to be waiting outside the court. ;)

And quite probably an unmarked one, in case the donut eaters in the marked one are asleep. :p

It all depends on court area and available dates. When bailed from the police station you would get a court date.

Just to add, Drink drivers should be given a life time ban IMO

I hasten to add, it's NOT me!!

My neighbour got chased home by an ummarked Police Car a week Thursday ago at about midnight .... was arrested on his drive.

He hasn't made himself available for chatting as he would normally do - he drove yesterday, but not today.

Just wondering how quick they normally were - I did think 7 days.

So you were spying on him lol? How do you know it was DD?

A normal DD charge will take the same time to go to court as an sp30. after its a driving charge not a murder charge!

How do you know he was over the limit?.......I've had a fail to stop and a reckless a few yr back that got me a 2 yr ban
Oh and they will be watched every bored traffic cop will drive around his area when they have nothing to do

He could, obviously, have been clear at the Station .... the Police weren't too happy with him failing to stop - but, in his defence, it was an unmarked, black BMW - I would have been a little concerned about that following me close too!!

Can't help you with the first question,probably depends on what time is available.

You can drive to the court because you still have a licence, but if the court does take your licence off you then you are immediately forbidden to drive until you get the licence back.

People have been caught trying to drive away and been summoned again and lost their licence for even longer!

If he blew between 40 and 50 and opted for the statutory option of having a further sample (blood/urine) to be analysed.
If this is the case,he would be bailed for several weeks for the results.
During that time,CPS would have made the decision re the fail to stop/dangerous drive, so that both matters would be heard together.
Ordinarily,a seven day turn around stretches out to several weeks and he would be driving throughout this time.

Also depends how busy the courts are. Like stated it normally takes between 10 and 14 days.

As said, after sentencing, banned as soon as you step out of court.

If you 'can't' get a taxi/bus/train to/from court, then park well away from the courthouse, say, in a train carpark.

That way you won't get immediately nicked. And if they were to tail you on foot (highly unlikely), they'd think you were getting the train home (just hang around the waiting area for 15min to make sure the coast is clear, before getting into your car... :D).

Not read the whole thread but for a standard Sec 5 RTA you will be charged and released on bail. At that point you will be told the date, or you should be. It will be anywhere from a few days to 3-4 weeks depending on what court dates are on the system.

If its a bit more complicated than that and you are not charged then you will be bailed to return to the station at another date - where you will be charged - or not - and that cycle might go on a few times - all depends.
