Caught speeding but no NIP? Am I OK?
 
Hi All,

Caught speeding on the motorway the other day, pulled over by unmarked car. They got me using VASCAR.

It's a fair cop, but was just on the boundary between a fixed penalty and court, but I got court.

They said they intend to report me for the offence and I'll get a summons.

They didn't give me any paperwork there and then.

Do I just wait for the summons, or like a speed camera do they still have to send me a Notice of Intended Prosecution (NIP) within 14 days? I ask as I've had nothing and it is nearly two weeks since it happened.

i thought you were suposed to be given paperwork to sign and then given a copy?

VASCAR is hugely un-reliable ... I'd contest it if you ever get a NIP. Check Pepipoo site to make sure though.

Does seem odd not to issue you with any paperwork at the scene.

I was told it could be up to a year and I didn't recieve any paperwork at the scene. Never came though!

I'm afraid that if they gave you a verbal warning of prosecution, then it already counts as a NIP.

You just have to wait for the summons.

I was stopped for speeding and wasnt given any paperwork at the time, got a court summons about a month later.

What is a NIP (Notice of Inpending Procecution)? I'll admit it's been some years since I was in the UK, and got nicked for speeding, but I don't recall anything about a NIP.

Been nicked in several countries for speeding (Which is arse revenue gathering and nothing to do with "safety" IMO), but last time for me in the UK was on the M4 between Swindon and Newbury. 101mph, and I think no points and about 45 quid fine. The coppers were surprised it was my car. They thought I'd stollen it, I guess they thought it was driven like it was.

Nothing might ever turn up, i am still waiting for my section 59 paperwork, although i am doubtful it will turn up as it is not even valid any more :lol1:

That is your NIP.

They've 6 months (IIRC) to get the summons to you.

just to add a friend got caught - 64mph in a 40mph - on the A1 at the roadworks by Hatfield

NIP just said peeding between jct 4 & 3

and I think they just have SPEC's there

so looks like SPEC's do get you

i was caught speeding doing 50 in a 30 had 6points already took 3 months to get my court date a week before my 6points were due to come off

If you get pulled over they will say something to the effect of "You will be report for the question of the consideration of prosecuting you for the offence of......"

The officers then have 6 months to lay the information to the courts and a summons will then be issued requiring you to attend the relevant Magistrates court

I just got back from court today, i was stopped by an unmarked police car, you will get summons in the next month or so, u will have to make a plead.

You don't have to turn up to court, although it might be advisable depending on how screwed u might be when u get more than 3 points which u will plus a fine. Otherwise just do it by post.

You must be close to loss of licence then at 60% greater than the speed limit!

pleaded guilty by letter the day i got my summons in and appeared in court for sentence got 3 points and 250quid fine reduced to 175 for pleading guilty straight away

its never worth it when you get caught but to late to be going if only i had slowed down thats the risk you take when you go over the speed limit

And if you werent told verbally that you were being reported for consideration... etc, then itll be pronted on the back of the HORT form or similar.

The NIP in fourteen days things doesnt apply to cases where youre stopped by police officers.

Ouch, the other bloke was a bit luckier than that. I thought his previous 6 points would have got him a worse penalty.

my other 6 were for 100 on the a9 on the way to inverness i only got £200 fine for that but i do play the 6 kids sympathy card
