Fixed penalty notice, offence code not filled in?
 

Hi all,

I was stopped for speeding, the ticket says

brief wording "excess speed 70mph" but the offence code hasn't been filled in.

Worth fighting?

Wouldn't of thought so. Its just an internal code, each force uses a different one, to assist with processing them.

I assume you were actually speeding? If not obviously it's worth fighting!!

yeah i was slightly, was pulled by an unmarked car.

but obviously shouldn't the offence code be filled out, like SP70 or something?

The offence code on the ticket is different to the code that goes on your licence

As said above get some legal advice. But in my opinion, surely if the ticket has a section for an offence code, you would have thought it would be needed to be filled regardless if different police stations use different codes (Otherwise why have it on an official ticket?). I would have thought the form is technically incomplete / void. Therefore it’s not worth the paper it’s written on.

But the NIP isn't the evidence the Police will rely on in court?? It's just a notification, nothing more.

What type of road were you stopped on, A road or motorway? The comment excess 70mph is the internal offence.

Sp30 or sp50 will be the offence code on your licence depending on what type of road the offence took place.

Being stopped by the police is extremely difficult to beat. Unless you are facing a ban, either through the speed you were caught at or by totting up, then don't fight it.

Ignore the tosh that some people write on hear and take legal advice as mentioned.

Not sure, I know even if you refuse to sign the ticket it is still valid, I would suspect it is still a valid ticket, asuming the offence wording is correct to be honest.

Might be worth fighting however if you do you may end up with a bigger fine and court costs

Forgive me for adding "tosh" but I spend a fair bit of time dealing with tickets just like this.
The SP code, I regret to say means nothing. If the officer was in an unmarked car there is a very high chance he has video evidence. He will have filled in his note book and it he was double crewed so would the other officer.
They would have had to complete a file and statements about the offense. With all that a missing code wont mean anything.

I would take the points and be thankful I Wasnt going 10 MPH faster.
