So if I were to put a post up saying New_scooby_04 do we like him as a moderator or not, vote yes or no (and BTW I had no problem with him before he was gifted the "cluehammer", seemed like an okay chap until then). Would that be locked or would the "community" be allowed to speak?

I'm guessing it would be locked, based on evidence so far, because you wouldn't like the probable outcome. But hey-ho, give it another few months and you'll have nothing left to moderate anyway :D
