Legality with Tree problem ?
 
I have a problem with some very large conifers in my neighbours garden, them being close to my house and getting taller by the day.
they are in the region of 35 feet and about 35 feet from my house and they block sun light into my house.
I have new neighbors and have approached him and asked if I can cut them, but he said NO as they give him privacy as they do me but I lose light.
Has anyone had any joy with enforcement from authority's etc.....

Daren, privacy I can understand, but you do not need 35 ft tall trees for privacy.

Do they over hang your property?

High Hedges
A government Bill giving Local Authorities the power to control evergreen or semi-evergreen hedge heights seems set to become law. A residential occupier can complain to his Local Authority if :

1. A hedge is evergreen or semi-evergreen.
2. It is over 2m in height.
3. It is "unreasonably restricting " light to the property.


The Local Authority can issue a "remedial notice" on the owner eg to reduce its height. Failure to take action can result in a fine of up to £1000 and daily fines for so long as the failure continues.

Hi Neil yes they do hang over but not very much. I know I can cut this part without his permission but do you know how I stand with the cuttings :norty:
ie. can I put them over the fence or send him a bill for disposal etc...?

BeeSTI just go to the council.... you should also check your house insurance as some have clauses that if you have a tree within a certain area near your house and it is over a certain height then your insurance could be void... Just something else you should look into
