Advice req re. incident with parking attendant.
Bit of a mad one this.
I left my cars on double yellows outside my house this morning. Was inside for a few minutes and the mrs said there was a traffic warden/parking attendant there. I go back outside and she is stood in front of my car just printing the ticket. She said you have a ticket, I said no I dont as it has not been issued. Get in my car start to drive off and she jumps off the pavement to the side of my car where she had moved to and tries to put the ticket on under my wipers while im moving away. Result was her foot getting trapped under wheels and it ran over her foot. She rang police on the spot and reported me for assult :confused: I went to local nick to report a road traffic accident. Spoke to and gave a brief statement to very helpful copper. He obviously didnt like wardens and seemed to say that I should be ok as she has already said the car was moving when she attempted to serve ticket. Questions I have is will i be done for anything? As regards the ticket she didn't serve it correctly, has scatched my car when she jumped against it. what should I do now? I left the ticket on the ground where she dropped it following her foot being run over. Should I contact them or wait to hear in the future? Or send an invoice for th repair? Unbelievable that she would go to such lenghts when I was clearly in the know about the issuing of tickets and my rights. Police have confirmed that I was well within my rights to drive away so long as I did in a safe manor. Which I think I did. Seat belt on, check mirrors and offside for traffic the pulled out. Any thoughts? chop :) |

If she effectively put herself in the way of your car, you can hardly be done for assaulting her. Its not as if you mounted the curb and ran her over in a rage over getting a ticket.
Personally I would seek legal advice about the damage she has done to your car by scratching it. I would make sure she or the local council pay for any damage incurred and all your expenses. Once you've won your case ask if she'd like your autograph on her cast :D |

I cant see the BiB being that interested but I would expect a civil PI claim TBH. I suspect some of these TW types are often putting their safety last on the hope of a claim.

Child ran out in front of me once, lucky for him he hit my front wing rather going over the bonnet. I would continue with a damages claim myself. Suggest you find a witness. |

I reckon as Chopper had committed an offence and the Traffic Warden had issued (ie. it was being printed) a ticket in relation to an offence that had already been committed Therefore, Chopper was effectively breaking the law by not waiting to receive his 'naughty boy ticket' Just a guess but anyway, reckon Chopper is prob in a spot of bother IMHO :( |
Don't get me wrong, in an ideal world I'd run over every traffic warden but all I'm trying to say is that the OP won't have heard the last of this and may be looking at a due care & attention charge at the minimum. The warden stepped in front of the car as he was driving off, when he really should have checked there were no pedestrians before setting off. Whether they jumped in front of the car on purpose or not is irrelevant.

Any thoughts? chop :) chop had a similar thing a while ago. Guy was trying to issue me with a ticket and wanted to detain me whilst he printed it. Thought 'sod ya', drove off with him literally flinging himself and the ticket in my direction. Avoided both whilst shouting 'you will never take me alive you ****er !! ' :D I think in your case, you are in a spot of bother and may have some legal issues to deal with. |
