Right, in the spirit of Jerry Springer.....

Give me your opinion on my morale dilemma

Situation:

When I brought my Type-R it had a Personalised Plate...... this was left on by the owner and I agreed to switch it back to him once the log book was back from DVLA.

My problem is I've had a few "minor" issues with the car (all which are rectified or will be after the Mocom magic) and the guy is asking me when we can switch plates back.....?

Do I......

A) Tell him to ram it and keep the plate

or

B) Meet up and do the switch back......

I think I'm leaning towards B), but thought I'd open it up to the floor :)

P.S. the plates not that great anyway!!!!!

I'd say 'B' too, why give yourself another headache if the car is fixed, just not worth it.

Agree to meet the fella and when you do meet tell him that you have sold the plate to pay for the minor issues you have had with the car. :norty:

Then pick up a chair and hit him with it and tell him that you used to be a woman and that you are going to have a boob job and have been sleeping with his best friend and brother.................:freak3:

Don't know if Milamber is in agreement, but 'technically' you are also committing a theft by dishonestly holding onto the reg.

Perhaps this is another reason why you should just get it sorted ;)

I thought technically as my name's on the log book with that reg. I own it?

If at the point of purchase you agreed the plate was his, and now your thinking about holding onto it. You have 'dishonestly appropriated goods (i.e HIS plate) belonging to another (i.e the former OWNER) with the intention of permanantly depriving them of it'.

When its all said and done it would probably come down to a civil dispute. More aggro than it's worth.

surely the guy would need some sort of writen proof or a witness and statement to back it up?

i'd say b as well as that's the type of person i am. but i would tell him that you've had to pay out a lot of money on the car and see if he'll give you something towards it.

With regards to helping out with costs for problems with the car, a couple of phrases come to mind, Sold as seen and Caveat Emptor.

no such thing as sold as seen any more. even on private sale.

I can't see how there isn't any such thing as 'sold as seen' anymore, if there are problems that the seller (legitimately) didn't know about, how can they be held responsible for them.

Does it mean you have to disclose all faults with a car ????

If so, there would seem no point in AA/RAC/HPi checks then ?

i know people still put sold as seen and i think if you can proove that the seller knew about the fault and told you everything was ok you can legally do something. would be pretty hard to do though.

if you ask the seller if the car has been involved in an accident and they know about it, they have to disclose this when you ask them. i found this out when i came to trade in an old fiesta a few years back. i bought the car in good faith and didn't get an hpi check, doh! when i traded it in they done the check and told me it had been an uneconomical repair write off. i phoned CAB and they said as long as you don't withold information if a potential seller asks then that's fine. if they ask you have to tell them otherwise it can cause all sorts of hassle etc.
