This appeared next door - what would you do?
 

I am fuming!

Chap next door wanted to develop his barn into a dance studio. Ok I thought as long as it isnt long hours and noisy.

He gets planning permiss as long as he soundproofs the building and limits the hours - live and let live, even though it is a purely residential street.

Now I find these THREE industrial air con units installed next to my new fence and PATIO area [camera right].

I have sent him a letter asking they be moved to any of the other 3 non residential aspects of his building, and have a Freon hacksaw at the ready [!] but what do you make of this?

I aint no Victor Meldrew but, after spending a week building my new fence and patio area next to these noisy fans and compressors I am LIVID!!! Coul d seriously damage my property price and resale potential if I sound like I'm living next to an industrial estate?

There are 3 big power switches above the units.....
Stack bad smelling objects near said units, won't be so fresh then.
Complain to said council that it obstucts light in to your garden, along the lines of invasion of personal space.

That would piss me right off as well to be fair to you.

Switch them off hack the cables, then stick them on Ebay. Keep doing this till he moves them to another elevation.

Contact the council, noise is a health hazard too, surprised that there is no sound information on the plates.

Let us know what happens, he should move these to the other sides of the building....

They are heat exchanger units aren't they? I've got one outside my office/conservatory but it isn't very noisy at all. I expect they are sited there because that location was the best for the pipework to the aircon units inside. But neighbour could have been more thoughtful.

Have you actually heard them operational yet, Diesel?

I've got three of them puppies on the balcony outside my apartment, and if I have the aircon on whilst I'm watching the TV I can easily hear the exchanger fans stopping and starting over the TV.

I personally wouldn't want them just the other side of the fence from my new patio:(

Surely the planning permission would have indicated where these would be situated?
If not then I presume you could dispute their location, if they were fully present on the plans then I presume you wouldnt have a cause to complain.

Without a doubt you cant do anything illegal, no cutting wires or switching off etc etc. This would be criminal damange and you would get nicked.

You need to go legal, so look at the planning permission, bylaws and work out if this unit is allowed so close to your property, or if there legal issues regarding the operation of this units, etc etc.

You then need to apporach the council and find out what your rights / position is. You may need to see legal help and write to your neighbour. You might need to get video evidence, sound recordings etc to prove your case.

This seems to be so common now in 2007's Britian. No one really gives a dman for their neighbours. Ive had recent issues with my ones, building to close, loosing my privacy, and councils just dont seem to care.

Britian is becoming more of a "F*CK YOU" nation, which is a real shame.

However, thinking in that way, whats stopping you watering your garden, and oh dear, whilst watering the plants on yourside of that fence, that some water may go over on to his A/C units ?? :-)

Have you tried asking him nicely to move them, explaining why? I've found that people rarely do this and things escalate into legal battles as a direct result.

You will never be cold sitting on your patio. The heat the exchangers blast out is amazing. Cool inside roasting outside.

We had 3 exactly the same outide our offices, they are not that noisy, but then I wasnt sitting outside on the patio. They do have a loud click on and off.

Fans that size are bound to make a decent amount of noise. Not to mention all that heat heading straight for your fence. The heat may warp your fence, or affect any plants you are trying to grow up the side of it...perhaps time to plant stuff that does not like heat?

Definitely get onto the neighbour to see what he will do. Failing that its time to go legal to see what they will do. Then its hoodie and wire cutters time.

They aren't that loud ;) and they look like they've been mounted on anti-vibartion feet as well.

You won't even notice them, unless that is you:

1. Turn your television off
2. Turn your radio off
3. Tell everybody in the house to keep quiet
4. Go up to the fence and put your ear against it
5. Hold your breath



....and then..... once you've done all that..... if you can still hear it running....

But that's (noise from the condensers) surely allowed bewteen the hours of whatever and 10PM isn't it?

As I can't see that you need planning permission to install those units, and they don't run 24/7....

Don't get me wrong though I agree its not the best for Diesel's garden/relaxation but what can he do?? apart from speak to the neighbour, and I can't see him being interested.... :(

As someone said before speak to the guy first. My neighbour didn't like the shape of my roof ( which had started to go up) because it differed to the pp drawing. My architect assured me that I would get away with the new roof no probs, staked his rep on it. Neighbour was being a bit of an arse talking about legal action etc even though he didn't have a leg to stand on.
I decided to appease him as I didn't want to live next to someone who would have it in for me for the rest of my life and get me involved in legal proceedings even if I did win, it would still be hassle.

Your neighbour may have the same outlook on life as me;)

Easy answer is this.

Rip out the cables on a night time, or break them in some way. He'll soon get sick of having them fixed every week.
He'll realise it will be cheeper to move them.
If he gets clever and installs CCTV, shoot the camera with an air gun. :thumb:

Or three cheap but heavy duty padlocks, and lock the (red & yellow) switches to off ;)
