Escalating to a claim (paypal)
 

Bought an lsd for my mini but its turned out a duffer. Missing bearing, welded shafts etc. Original ebay advert was fairly small,

"Mini Salisbury LSD competition limited slip diff. Good Condition. Taken from race prepared car. Complete with Shafts & Gears."
and a picture of the parts.

question to seller confirmed CWP was semi helical but is in fact standard helical.

plenty more info, but i'll keep it shortish.

I paid £315 for the item and £18 p an p.

The seller has agreed to refund the £315 (only when i filed a dispute with paypal) but wants me to post the item back at my expense and only then will he send me the money.

I feel its a bit of a bum deal for me to lose £30 for him selling me a duffer.


couple of questions?

How does paypal find out technical info such as standard cwp and all the other things that are wrong with the item if it goes to a claim?

If i take this dispute to a claim, do i get the full £333,including p and p? Also is there any admin charge? Do i have to send the item back?

Basically, i'm trying to work out if its worth me risking the £315 for the sake of £30.

HI you will get the full ammount refunded to you, including the p+p but it can take upto 30 days to get it back.

I've been in a similar situation, but not for that amount of money.
You'll have ot send the item back, so you will lose out on P & P.
Paypal will also state that they will refund as much money as they can get out of the sellers account - if he has already cleared it out then you get nothing.
Paypal stinks - it offers no real protection yet charges a high fee.

Edited to say - in my case Paypal wanted an inspection of the faulty goods by a specialist before making a judgement. Luckily I had a friend who did it, but an inspection of the LSD may also be an extra cost.
