Help Speeding
 

Hi guys, yesterday morning received a notice of intended prosecution through the post 1 week after offence. it claims my speed at 100mph says excess speed 60mph now as far as i am aware road they talking about is a 60 so this wouldnt actually mean i was exceeding speed by 60mph surely. it was a mobile camera guy out back of white van i was having blast up 2nd lane to get past traffic couldnt see him until past as traffic in other lane. need some advice to what this noip means will it be 3points 60 fine or will they take me to court and ban time. is there anyting i can do to get past this as i could really do without all this getting a bit worried now.:cry:

Good luck mate. If you were doing 80mph in a 60mph they would throw the book at you, let alone 100mph. I think some other Scoobynet members will throw some more light on this.

it was said that anything over a ton was a ban but you was only 40 over the limit it might just meean points plus fine .hope things go well for you though

To be going at 100 (and to consequently get a ban) you would only need to be doing 30 over the speed limit on a standard motorway. This guy was doing MORE than this so surely it's at least what he can expect? I'd expect ban time anyway.

This is how they word it - excess speed in a 60mph Limit is what it means.

Doing 100 means a ban I am afraid - maybe only 3 months ...... fine of around £150?

Insurance Companies don't like these speeding things, like 100mph!!! Expect to pay £100's each year extra for your Insurance .... after 4 years it should revert to what you pay now

Bear in mind the the ECHR are hearing O'Halloran/Francis case on the 27th Sept. This has every likleyhood that the UK government will lose and making Sec 172 requests to incriminate yourself illegal.

Due to the high speed you would be wise to seek specialist legal advice( not the local solicitor), again see pepipoo for links to such specialists.

Dont contact the police, you have 28 days to seek information, use them wisely :norty:

Last time i was done for speeding i was doing an average of 95.9mph on a motorway and received 6 points and a £300 fine. If you were clocked at 100mph then I think you'll be lucky not to get a ban.

Cheek! What's wrong with the local solicitor? I would suggest you seek a specialist solicitor, and he may well be local too...

speed where you exceed more than 30mph over the limit in any limit means instant disqualificiation. This is serious - get a good solicitor and sharpish

May be worth a post over at 5-0 as well, serving police + mag's so they will give you a good idea what to expect.

It's a bummer, but the only way the state can attempt to slow people down and save lives.

a few years back i was clocked on the m5 by an unmarked car at an average speed of 105mph i went to court pleaded guilty said i was sorry and that i needed my licence for my job (then courier driver) i got 5 points and 500 pound fine so i didnt argue oh yeah it was 2am empty motorway and good conditions aparently these were taken into consideration so good luck and get your self a bloody good solicter:)

Raw nerve tingling. If you're one of the specialist listed on the Safespeed/ ABD/pepipoo websites, then I apologise, but if not then you must be a common as muck conveyance/wills solicitor. :D

Having spoken to a few solicitors, most just say, pay up or plead guilty and cant be ar*ed with the technical defences, whilst the few listed specialise in road traffic law.

Yup, a slight tingle there, you're right.

However, in order to make the client feel he is in with a chance, a decision has to made as to the economic viablility of running a defence which will only give the client the possibility of an aquittal.
Let us say we are able to take instructions from him in the space of only an hour - this will be receiving from him the honest and fullest details of the alleged offence, the circumstances surrounding the incident, where he was going and why, who stopped him and what happened (including collar numbers of those present), what was said to and by whom, and all this as accurately as can be remembered. Shall we assume we can do this in an hour? That's £150 straight away.
Now then, off to court.
Court starts at 10.00 (usually) but our case may not be called until 11.30 or later, and there follows a trial as to the issues and the defence. That could easily be 2 hours or so and therefore the whole day is to be devoted to this relatively minor criminal charge. A whole day, plus at least an hour's prep for the day, could amount to 8 hours of your highly qualified and experienced professional's time. At 150 smackers for each and every hour, that's £1200 with no guarantee that you'll get off. And don't forget, you have taken a day off work too. If you don't succeed in court, you can add another £250 for the fine and up to a year catching the bus.

Given that scenario, what would you do?

Oh, and by the way, I had a plumber round only the other day. He was in my airing cupboard for about 15 minutes and charged me £30 cash plus had a cup of coffee made for him.

Rather off topic but I am going to say it anyway. If you can't drive it quickly then what is the point of an Impreza turbo? 100mph in a Scoob is nothing - it doesn't even feel fast. This guy is going to to through hell wondering how much it is going to cost him in fines and increased insurance and how long he is going to be without his car:( . If you are going to drive a Scoob then there must be some upside to balance the heavy depreciation and massive running costs. Without split-fold rear seats they are not even all that practical. Someone please enlighten me:confused: .

No need to panic m8 I was done at 108 on the m6 just outside lancaster.Was told if you turn up at court and at least look sorry you might get a lighter sentence. I drove down from edinburgh with my m8 incase I couldn't drive back and got 6 points and £350 fine. Not a bad result

Good on you speedyscoob for putting this guys mind at rest!! Also someone told me that 6 points on your licence doesnt increase your insurance too much, apparently 9 points is the killer!! Is that true?
