Picture the scene....

Princess Parkway, on the way into Manchester centre - three lanes of traffic with me in my Sti in the third lane (of course!) - traffic in the middle and the inside lane (a little ahead)a tow truck, towing an F reg Fiesta.

Suddenly a mechnical piece drops from the fiesta, bounces through the middle lane without hitting anything and bounces towards me! Hit the breaks and pray! Barrier on the right and traffic on the left! You can do nothing but wait for the crunching sound!!!

Front nearside Sti splitter smashed! (and this the day before the Northern Meet!)

Managed to get the Tow truck to Pull over - however, after some heated dicussion I am left with two (legal) options:

Claim on the insurance (not worth it with the excess)
Involve the Police and claim on his insurance (can't see this being easy - serious lack of eveidence!)

Any one got any other ideas?!?

Oh, and if any one has got the Nearside Sti splitter for a 94WRX Sti - let me know (bright red would be good!)

Did you manage to recover the "mechanical piece" from the Fiesta? - surely that would help your case!

I reckon the mechanical piece would be circumstantial - it could of come from any car?

I could try and find it...not sure if it would be worth it!

A few years ago this happened to me driving the wife's Punto. I hit an entire back box in the middle of a dual carriageway.

With respect I think you got off lightly, we had damaged steering and also holed the sump. Being unable to drive on I could not question the van that had dropped the exhaust and I just had to claim for the damages from my own insurance, £500 worth.

Some-one did say to me that the local council are responsible for debris on the road but I did not take that up further.

Maxwell - I think what were saying is to get anything back we are looking a months of letters and calls to the council...I don't think it is worth the effort!

H, I think the driver of the recovery vehicle could be charge with having 'an insecure load' - but I am not sure to the point of law.
Sorry to hear of the damage to your car.

I am positive that the Tow truck driver/company are responsible - but I can just see it taking months and months.....
