Apparently RockStar - the company that developed GTA3:VC, has curcumvented the PS2 only agreement by removing the "Grand Theft Auto" tagline.
According to IGN it could well be out this year, with added bonuses of crisper textures, higher polygon count, download content from XBox live and ability to play music ripped to the xbox HD

but it's been in the PC for a quite a while now. and that was called GTA3 - Vice City.

That's becuase the PC is not in direct competition with the PS2 - aimed at different markets.
Much the same way that PS2 exclusive games can some out on the Gameboy - as it too is aimed at a different market (until Sony get their handheld out)
