cut and pasted from Wheels as no response

Is it ok to put a new tyre of same brand and tread pattern onto the same axle as a part worn ie 5-6 mm tread left. Got a slow puncture that can't be repaired but will be replaced under warranty, should I meet halfway for new tyre on opposite side or will the 2-3 mm tread difference be ok.

I would probably meet half way for a new tyre. I had a nearly new nearside tyre slashed at the road side earlier this year and just replaced that one at first (Goodyear Eagle F-1). The car felt really weird and it pulled very strangely during cornering, even though there was a minimal amount of difference between the tread depth.

I'm not an expert though so don't take just my word for it.

yeah, don't mix new and partly worn's on the same axle as it'll make the car handle funny. Even though they may be the same brand the difference in tread depth and even the differences between one tyre batch and another will give differing grip, which is not good on the same axle.
