Actually it is 14 days as a friend of mine works for a certain part of the local police and she knows the facts ;) (mainly as shes the boss :P)
Its 14 days from the incident, the NIP has to have been processed by then and sent out within the 14 days, it should say on the NIP the date it was processed and sent, after that you are not legally obliged to own up to the offence, its basically out of date ;)

Yep. They only have to notify in 14 days. They can then leave it as long as they like to bring it to court.

hmmmm, if he couldn't get you off on the simple fact that the NIP was out of date, he/she is NOT what I'd call a 'top' solicitor. :)
It is the LAW, not my or any others 'opinion', about the 14 day nip notification.
NIP must be DATED within 14 days of the OFFENCE. Doesn't really matter when you recieve the thing although if it's a while then you may have a case if you can prove it took n number of weeks to be 'lost' in the post, this is unlikely and most will get to you within 1 to 3 weeks.
Ultimately, be careful where you speed. ;) :)

Well 30 years driving and probably just got my first Ticket:(
My own fault after a mile of contraflow and loads of bunched up cars in the rain :( doing 85-90mph on Dualcarriage way with one car in front(150 yards+) and three behind 20yards:( I saw on top of a bridge a white hire van with side door open couldn't slow down much because of cars up my arse:( and no where to hide as other lane full:(
Could of slammed the anchors on and watch the big accident behind but just gradually slowed to 70 mph but can only assume it would be over measured distance as no detector alarm:(

14 days for a Notice of Intended Prosecution otherwise they can't touch you.

yep 14 days officially, but they do allow a few days for postage so to be in the clear about 16 days.

Agree with NotoriousREV - 14 days for the NIP.

The fourteen day thing is total crap.
If you have seen a post of mine somewhere in here, you will know I have been done more times than I have had hot dinners
most of which took way longer to come through than 14 days.
They did once shoot themselves in the foot tho.
Taking 3 yes 3 months to come through but by this time some old points had expired and I got away without a ban.
I wrote a letter to the constab about length of time to issue ticket..... Didn't care less,I was spotted speeding and details were recorded end of story, brought it up in court... no eybrows raised there either.
I'll dig it out if you want proof.

If it's any consolation - if you do get convicted (3pts and a fine probably), the points won't make any difference on your insurance....

I got 6 of 'em!!!!!! (granted SP30s) first 3 made no difference (in fact, insurance company thanked me for informing them, but it would make no difference at all!!!!:eek:

The 2nd lot only added about £20 to my premium....

if i remember the 14 day thing is to try to prevent "oh it was WEEKS ago, how could I possibly remember who was driving?"

If you cant say (not WONT) then they cant do you can they? Who was it recently got away with it because there were a few of them in the car and they claimed they didnt know who was driving at that point as they had been taking turns, and they got off. Army or policemen or summat like that I think....

It IS 14 days from the date of the offense with no allowance for postage.

This was recently proven in case law, when a trainee laywer went to court after his NIP arrived after 16 days.

If you are stopped and verbally cautioned, or given a ticket that counts as your NIP so they then have 6 months to summons you and take you to court.

The verbal caution can take many forms as well.

I was travelling on the M180 Eastbound towards Goole, the day before my sister's wedding.

A police car catches up to me, tells me to slow down and the roars off.

I look at the speedo and the needle is pointing at 120mph (not bad for the Renault Megane 19.9DTi), the heart starts pounding and I feel sick and relieved that the nice police let me off.

Now it was sunny, dry, an empty motorway and I was very late running errands for the next day. No excuse I know but there you go.

That was the 18th June, sometime in September I go home to an answer phone message from a PC in Acton police station wanting me to call him urgently. I call and then discover Acton nick is not 24 hours!:rolleyes:

Call him the next day, wait for him to come back from breakfast,:rolleyes: then have a very stroppy policeman tell me down the phone that papers had tried to be served on me and I no longer lived at the address. (Moved and forgot to change the V5 form) The best bit was I was supposed to be in court that day!

It turns out (when I get the police statement) that the "nice" police in the car were on their way to a firearms call. Saw me out running them so they did a speed check, told me to slow down and then carried on!

I end up in court on the 30th Novemeber, even the judge (I didn't get magistrates) said I was unlucky not have had the case pushed back two weeks. I pleased guilty got a 28 day ban and fine... drank like a fish over CHristmas!;)

You should check that if you are pulled over that this constitutes a verbal NIP. If it does not the 14 day rule applies.

For Gatso etc is 14 WORKING DAYS - Found this out myself when I got caught on cam and got away with it :)

Any other traffic offence is 6 months from the time of initial offence, i.e Vascar, Truvello, White van on mway bridges etc.

Deosn't the 14 day rule change if it's a company car? I thought that it could be served in 14 days to the owner of that car (company car blokey) and then they were allowed a certain period of time (a few months) to determine the driver.

Might be wrong though

it IS 14 days from midnight of the alleged offence- I have done this twice in the last 6 months both times for going through red lights in london - the law is very clear on this, they have to serve you with it within 14 days if not, nothing they can do. I didn't do anything more than phone them up either, told them I had their letter post dated and they confirmed there and then they would take no further action.

My best friend is a copper and has only just finished his 3 months of training and did all this stuff only a month ago so I think he should know!

Also remember that the 14days will not apply to a NIP should there be any circumstance that stops it being delivered to you....

i.e you have not updated the DVLA with your correct address so it gets delivered to the wrong place. etc
