Accessing Gmail when account has been removed from outlook
 

In need of some advice and will be seeking legal advice but I'm more curious to how this has been achieved.

A companyI uses Microsoft exchange server and staff all use outlook as an email client on desktops and use a work related email account and address. An individual has linked their personal Gmail account and has since left. The individual is adiment they removed and deleted the account as well as logged out of the desktop version.

However the company have been able to access the individuals account and is now using the information in a court case against them, they state it was still linked/logged in.

Now I'm not the individual however I am linked as we own a company together.

What I'm curious to know is how they would be able to achieve it and no so much the legal standings as we will be seeking advice.

Did the emails present as if in the company "inbox" or was it obvious that they were in a separate (personal) account?

Also did you continue to read said emails after you realised you were accessing his personal emails.

That will be the crux of the argument i believe.

Not saying I totally agree with this, but something I took note of as a contractor myself

Depends were the emails sent/received before they left?

Basic version is if they are emails were while under employment they could be retrieved from a desktop snap shot or replay. And they have every right do that. Any data on a works PC now belongs to them.

If it's emails after the departure it's a grey area. Yes they could use a replay to login but actually go through the emails received at a later date is very questionable.

No it was a setperste mail box

Sorry some confusion there. I have left the company and we set up for ourselves. The company where we were has acessed his emails. And he is sure he removed the account. I'm struggling to work out how they've been able to re open the account and have been reading his emails

Thanks for that I'll take a read. The issue is more to do with the fact he is adamant he removed the account before leaving. So don't understand how they've managed to get emails for example from last week

There are some while under employment which we appreciate there's no argument. It's emails being used that we sent after employment ended. Sorry you say a "replay" never heard of it,
